Tier 2 dependent - ILR eligibility

Post by throwtier2ilr » Mon May 13, 2019 7:25 pm

Hi,

I'm trying to figure out how this works. I'm going to be switching from Tier 4 to Tier 2 soon. I'm planning on getting married to another Tier 4 student a year or two into my Tier 2 visa and having her switch from Tier 4 to Tier 2 dependent.

I'll be eligible for ILR based on 5 years on Tier 2 and will then switch to ILR in 5 years time, my (then) wife will not be eligible to apply for ILR, due to being on Tier 2 dependent for less than 5 years.

What does she do in that case? I presume she can't remain on as a Tier 2 dependent, since I won't be on Tier 2 anymore. What (f any) visa will she need to switch to and when will she be eligible for ILR?

Thanks!

If you get ILR based on tier 2 and 5 years residence, your spouse can continue as a tier 2 dependent until they qualify for ILR. The rules permit this.
