Hi
I was on Tier 2 General and went on to receive my ILR on 8/8/2018.
My wife is still on Tier 2 Dependent Visa which is due to expire on 14th Aug 2019. Her 1st entry visa was valid from 25th Sept 2014 though she entered country on 3rd Oct 2014.
Now considering she is eligible to apply for ILR 1 month before her 5 year completion, she should be eligible to apply for ILR on 25th Aug 2019. Does that mean I would have to extend her Tier 2 Dependent Visa for a year just cos she is falling short by 11 days if its based on 1st entry visa? If it based on 1st entry date into country then she falls short by 19 days. Either way .... the point is that it is less than a month!
I would have to pay nearly £2000 (£1200 IHS + ~£700 application) for her extension and then a month later another £3200 for ILR application!
Is there any other way to argue my case to avoid this massive drain on finances, time, energy etc!
regards,
Rocky Paul.
