ILR eligibility date

Post by allu » Fri May 03, 2019 2:22 pm

Hi,

I came to UK in Tier2 Visa in September 11th 2014. When is the earliest date I am eligible to apply for the ILR in the 5 years completion category?

https://assets.publishing.service.gov.u ... -v18.0.pdf.

I found the below from this pdf, but confusing me so asking.

Calculating the specified continuous period
Applicants can submit a settlement application up to 28 days before they would
reach the end of the specified period.
You must calculate the relevant qualifying period by counting backward from
whichever of the following is most beneficial to the applicant:
• the date of application
• the date of decision
• any date up to 28 days after the date of application

It is useful to state when you are asking for other people or ask friends to register and ask their own questions.

Initial Tier2 application made date - July 19th 2014.
Initial Tier2 visa issued date - August 1st 2014
Visa validity starts date - September 11th 2014.

So you mean to say I am eligible 28 days before August 1st 2014(Initial Tier2 visa issue date).

Initial Tier2 visa issued date - August 1st 2014
Visa validity starts date - September 11th 2014.
What date is your visa valid from date??

If your visa START/VALID FROM date is 11 September 2014, you can apply no sooner than within 28 days before this date in 2019.

Re: ILR eligibility date

I am working in Tier2 general visa since Sep 2014, for the last 4.5+ years and nearing my ILR in Aug/Sep this year. I have two questions.
1. I had applied for tier1 exceptional visa endorsement (with tech city) in 2017 and it got rejected in the first round(endorsement rejected, not even gone for the visa application). Can this impact my ILR or delay my ILR approval.
2. Should I consider this as a visa refusal and mention in my ILR application. Telling you again - I applied only for the tech city Tier1 exceptional visa endorsement, was not eligible for the second round to apply for the visa.
3. Currently, I am with my third company in Tier2 visa, I had a employment gap of 45 days between first and second company and 40 days employment between 2nd and 3rd company. Any chance of this affect my ILR.

Thanks.

Thanks for the reply.
Regarding
#1. You mean to say it won't even delay my application
#2. My solicitor asking me to mention this as a 'visa rejection' in my ILR application. Also FYI, After my Tier1 exp endorsement rejection in 2017, I went for a vacation in Dec end and when I travelled back to UK in Jan 2018, I was asked to wait in the immigration entry check since the visa rejection was shown in their system. In that case it looks like a visa rejection isn't it? My point is if it is visa rejection then only it occurs in the Immigration entry system.
Please reply me.

You didn't apply for a visa. You applied for endorsement. Feel free to mention it if you must.

ILR due

Post by David A » Fri May 17, 2019 12:45 pm

I am from India and eligible for ILR in two months. I got separated from my wife, who was on dependent visa in the UK. As usual like any other Indian wife she started filing criminal cases against me in India. I am not attending any of these cases and my Indian lawyer attending it. The cases are in very early stage.
If she complaints to the home office about these cases from India can it affect my ILR.
Do I need to mention about these cases in my ILR application.

Thanks.

All the cases are filed by her. She is in India now for the last two and half years.
One DV case against me, my parents, my siblings
One is a criminal case against only me, alleging that I threatened her and beat her.
One is a 498a that is rejected by the police.

The two cases are in only summon stage.. not even reached the trail stage.
When the case was registered I was in the UK and I haven't not even travelled for the last one and half year to my country. But, all the fake cases booked in this time.
I have all the proof for she took treatments for mental unsuitability.
If she complaints to the home office about these cases from India with my details, can it affect my ILR

The DV case was filed on Oct 2018, last year, against me and family.
The other criminal case was filed on Feb 2019.
But, I have not travelled India since 2018 April.

I have a very clean record in the UK not even one traffic fine or anything in my name.

Both the cases trail or argument not even started. Even she doesn't know my full name and in the cases my second name is wrongly spelled. Any complaint to UKV with my details affect my ILR?

Thanks.
