Need someone help please:

Hi my situation is as follow:

I enter in UK on Tier 2 ICT visa in Aug 2010. --------- My Wife and dependent child enter Feb 2011 on dependent visa

We have been continue in UK with many extension without any break myself and my dependent(Wife + 2 child)

My 10 years would be completed Aug 2020 ------ My Wife and dependent 10 years completed Feb 2021

Questions:-

Is there anything in rules that my wife and children can apply for ILR with me on Aug 2020?


Is it ok for me, if I take ILR on long residence on Aug 2020? Or, I should submit on Feb 2021 with dependents?


If I obtain ILR on Aug 2020, can my dependent continue on the Tier 2 ICT dependent visa so that they will apply ILR on Feb 2021?

OR any other exception in ILR for dependent children who has been living more than 8 years in dependent visa?

No. Long residence ilr does not allow dependents to apply for ILR with you.

Your choice. Each person apply for long residence ILR must meet the requirements on the own. There is no dependent concept for Set LR.

Yes, provided they don't travel out of the UK or their visas are not curtailed.

If they plan long residence ILR, all visas count. They cannot apply for ILR based on tier 2 and 5 years residence if you apply for ILR based on long residence.

So can they apply for ILR on the basis of my successful ILR?
Also my son was born in UK on Nov 2011, can he alone apply for ILR on the basis of when one, or both of his parent has settlement(In this case after my ILR approval)?

No. She will need 10 years legal stay/visas herself to qualify for ILR LR.
Also my son was born in UK on Nov 2011, can he alone apply for ILR on the basis of when one, or both of his parent has settlement(In this case after my ILR approval)?
Once you have ILR, you can register your UK born child as British on form MN1. He doesn't need ILR.
