Parents have ILR- can child travel abroad

Post by asifvet » Wed May 22, 2019 8:49 pm

Just wondering we both have got ILR but our 11 year old daughter still on tire 2 dependent Visa until dec 2019.
My question is she she is going to France with school, will she have problems coming back? Is her Visa still valid?
She was born abroad, and lived with is for 10 years in UK. We will apply for her ilr once she is back from school trip.

Thanks in advance

Your previous posts suggest you applied for ILR based on 10 years long residence! Is this correct?

Yes, I applied for ilr based on 10 year long residence. Before getting ilr I was on tier2 Visa and my daughter my dependent, the tier2 Visa for all of us was valid until dec 2019 but 10 years completed before that time so we applied based on long residence.

I want to apply for my daughter 10 year based once she is back from school trip from France. Someone told us there will be problems at border as dependent Visa she is on is no more valid because I have got ilr. Can you please advise?

It's only two weeks left she goes to France, and I m worried .
Thanks

She should not travel out of the UK until she has ILR as you didn't get ILR on pbs route. PBS dependents usually have to change their visas if the main pbs visa holder got ILR on long residence and not pbs route. The rules for this changed in April 2014.

If both parents have ILR, she can likely apply on form Set f now.
