Hi all,

Had our hearing at Hatton Cross today. We were there from 10am and left 3:50pm..long!

Judge said he would announce his decision in 4 weeks time. Home office had a barrister representing them which turned out to be tricky.

She was like a dog after a bone. She went for blood and hated sitting there watching her attacking us with all the stupid arguments they come up with.

Felt very positive about the judge so, its all about praying now and trust in the Lord.

I'll keep you posted!

The courts looks like a small room having some chairs
2 sides where 1 side is HOPO & other one is my barrister
He was all quiet 🤫 but my barrister said soo many things
At starting the judge asked me around 30 questions & ask similar questions from my life out answer match then my wife explains the difficulties going with me to India then they ask my in-laws ask them about my way of living with them.
The judge was very kind & he said they should get allowed the HOPO packed his bag meanwhite
After 7-8 days I recieved a letter & it says the date 4 days after the appeal

Would you mind sharing your timeline?

Timeline
Flr (fp) application : 10/2017 (application submitted before the expiration date of my last visa)
Contacted MP in June, 2018
Contact HO in July, 2018
Additional Document request for August, 2018
Waiting since then.
Received a refusal letter during the weekend with right of appeal.
Been married for more than 5 years
Husband got ILR since 2years
Kids are 5 and 2 - Just applied for them to be registered as British Citizen three weeks ago.
HO acknowledged that I meet the spouse requirement but no insurmountable obstacles why we shouldn't return home as a family unit.
Flr fp form was filled based on partner route not parents route.
Judgement was based on both and another reason for refusal was that the kids have not spent 7 years continuously in the UK. Even though they have their application for British Citizenship put in since 3 weeks and their dad having ILR.
Spoke with a solicitor who said our matter may not go to the court because all requirements have been met but appeal will be done on in a few days.
Application was done before my last leave expired. So I didn't overstay. We applied through this route because we couldn't meet the financial requirement. My kid's decision may be out before the appeal hearing too. I am being very hopeful.
October 18 Update!!!!

Just after receiving a refusal letter, the Kids became British Citizens. Refusal was received on the 27th of October, the Kids certificate was received on the 3rd of November. Appeal lodged on the 5th. Acknowledgement received today to make payment for hearing. Payment also made today. So waiting for the next line of action. We are hoping that HO may reverse their decision since it was based on the fact that the kids were not BC, even though their father has ILR and I didnt apply through parent route but partner route. HO also acknowledged that there is a genuine and subsisting relationship. Finger crossed.

Please can someone share appeal timelines, following payment for hearing?

Thank you

Current Update

- Went in for the appeal hearing - 21st of May
- God there but our judge didnt turn up so we were on the float list. This means that any Judge with an available space will have to judge our case.
- We waited for almost 2hrs
- My barrister went in the discuss with the HO rep and my case was straight forward - 2 Brit kids and husband with ILR.
- HO rep initially didnt have an idea about the case as it seemed because my case file was not opened until the day.
- Case withdrawn by the HO so no judgement at all.
- Judge asked if I was happy and I said yes.
- Now waiting game continues but it wont be long and at least I am sure that the reconsideration will be in my favour.
- Waiting for an official letter from the HO and Judge and my BRP card.

Thank you all and I wish you guys goodluck. For those of you that have shared your cases and encouraged others, I thank you too.

I will post my next update.

it should be with you shortly, so meet32 if after sending additional documents and you dont hear anything after two weeks or longer does that mean the case is refused?

We have been waiting just over 6 months now and slowly going crazy!!

Flr fp based on a child:
Application done 23 November 2018, received acknowledgment and biometrics letter on 26th and done same day... heard nothing since!

I am British and my partner is Turkish, hes been visiting on and off since 2013 and we have a 4 year old son, we applied just before his visit Visa expired, we couldn't bare to separate our family again! Praying it is successful in 🤲🙏
