Brexit's effect on Non-EU Citizens with Indefinite Leave to Remain

Post by ash542 » Wed May 22, 2019 11:13 pm

I am a Non-EU Citizen with Indefinite Leave to Remain in the UK which was granted to me in 1996. I have been living in the UK since then.

Although I know this is unlikely to be the case but will there be any risk to my remain status after Brexit? Is it likely that the government will start to remove Non-EU citizens, even though they have the Indefinite Leave to Remain status?

Brexit, in and of itself, will have no impact on non-EEA citizens resident in the UK under the UK Immigration Rules.

However, the direction of travel is clear. Rules are likely to remain as strict and/or become stricter in the near future.

People in the UK already on ILR are unlikely to be removed. But it is always worth remembering that a prolonged absence from the UK can result in your ILR lapsing.

ILR and all other forms of leave are issued under the UK Immigration Rules and they can be changed much more easily as compared to Acts of Parliament. Therefore the rules on British citizenship is much less likely to change than the rules on ILR.
