Child over 18

Post by sandeshshah » Sun May 12, 2019 10:46 pm

Hi. Hope someone can advise. Looking for some advise for someone who is a British citizen living abroad. He has a child who is Kenyan citizen and over 18. He is planning on moving to the UK with his wife (Kenyan citizen) via spouse visa but we cannot get any info on dependant child (18 years) still in education. How can he apply for their child? Thanks for all help.

Is the child his?
If so the child can get a British passport.

Thanks for the quick reply. Yes, the child is his. The other complication is that he has just got his British rights (naturalization) by descent and his child was over 18 by then. Does that make a difference? Thank you.

Sorry, just to clarify, when I say child it means an over 18 years daughter. Not under 18.

A naturalised British citizen is British otherwise than by descent. However, if child was born prior to neither parent becoming British, then child is not British. If a parent was British by descent, then child is not British.

There is, to the best of my knowledge, no way to sponsor children over the age of 18 under the UK Immigration Rules (except in exceptional circumstances, such as the child needing personal day-to-day care that only the parent can provide, etc).

However, your friend can look at moving to another (non-British) EEA member-state before Brexit and settle there. Provided he arrives before Brexit, he will have rights to move his daughter there with him, provided he can prove dependency. The Netherlands is a good option, as it is largely conversant in English and within the Schengen Zone. So settling there will allow your spouse and family to travel within the Schengen Zone easily.
