Dear Gurus,
I am going to apply for Ilr in 1st week of july. Actually I got ext in may 2018 and my business partner got it in Aug 2018. We are having 2 full time employees from 1st july 2018 so 12 months employment will be completed on 30th of june. My question is
1. Can my business partner apply based on july18 to june 19 employment if yes on which date he has to apply?

Your business partner needs 2 FT JOBS that have existed for 12 months each after his extension date and so do you. Your cases are decided on individual merits so you have to fulfil your own requirements individually.
If the date of ILR application is less than 12 months apart, then he can use employment is the last 12 months.
For example if he qualifies for ILR in July.. he can claim from July 2018 - July 2019 as he will fall under thr exception rule then.

He has to apply exactly on 1st July 2019 (Note: EXACT) for to be able to claim 12 months immediately before 1st July 2019 i.e. 1st July 2018 - 30th June 2019. He need 2 FT JOBS that existed in these 12 months.
For you: You can only claim 12 months after date of extension. If you extension was approved first week of July.. Lets say 3rd July...You can only claim 12 months forward from that date. In that case you would need to send early FPS and salary slips for July 2019 also.

Date of online submission is the date of application. Once he applies on 1st July 2019, that will be considered date of application. Biometrics appointment date is irrelevant. You get 45 working days to provide that. He can provide it anytime during that.
Best to add a cover letter that your partner is relying on the exception rule as his date of ILR application will he less than 12 months from extension date.

“The jobs must have existed for at least 12 months during your most recent grant of leave or, where that leave was granted less than 12 months ago, for at least the 12 months immediately before the date of the current application”

Hi,
Current time lines for Tier-1 ILR is around 6 months. There may be further delay if your application is not straight forward or if you will need to attend an interview.
Rather than doing hell lot of paperwork and get stuck with out being able to travel for 6 months +, I prefer to go for super priority service on completion of 10 years. So that you can put all your efforts on running your business in the mean time.
This is what I do if I am in your situation.

Thanks bro for your reply but if I go on 10yr route then my dependent clock will start from 0 and she has to wait another 5 yr to get Ilr.. That's why I looking to apply based on tier1....

You can waive your application at any time and your visa will still be valid, also they won’t refund your fees since your application is been considered already

If I understood correct, you mean that if God forbid you are refused will your continuous residency be broken or not for 10 years as you qualify for LR in April 2020 and you have valid Tier 1 extension till May 2020?
Even if your visa is refused, your extension will still stay intact till May 2020 but how this can impact your LR wait for seniors to respond.

Thanks tier1147, yes thats my worry that there shouldn't be any chance to get visa curtailed eventhough in worst case of scenario...

Dear All,
I am on tier1 ext visa which is valid untill May 2020. 2 FT job requirements will be completed by end of this month. So I am going to apply ILR on 1st of july.
My questions are...
1.) In worst case if ILR refused still my visa will be valid untill May2020.
2.) My 10 yr will be completed in April 2020 so ILR refusal would effect on LR route?
3.) Am I taking right decision by applying Ilr next months or you recommend me something better?
4.) Can we send documents by post or just have to upload?

CR001 you can see I didn't get answer for qus2 ,3 and 4 even tier1147 was not aware how refusal can effect on LR and he asked to wait for senior members so I waited and repeated my query but didn't get answer even on different topic twice which were locked by you.
