Leave to remain

Post by Moeb » Sat Jun 01, 2019 12:06 pm

Dear experts and all other members

I appllied for Tier 1 entrepreneur extension which was deciline, I then applied for AR which was refused too. By the time they were revewing my documents for the AR I then become eligible for ILR under the long residency.

When my documents were returned to me on the 14 Feb 2019 I was given 14 days to make any further application if i think i have genuine right to stay in the UK.

I couldn't apply for the ILR within the 14 days given to me but was done through premium service 18 days after receiving their letter.

I applied for the ILR, they send me a letter that I dont meet the criteria for ILR, but they will give me 30 months.

Last week i got my biometric saying visa type Leave to Remain which last for 30 months. But the biometric didnt come with decision letter just the biometric as i applied through premium service.

My quetion is

1. Under what category are leave to remain permitted

2. Am i eligible to apply for ILR once my current leave to remain finish in 30 months time

Thanks to you all and looking forward to your advice

You were possibly given leave under FLR(FP). You should be eligible for long residence as you have regularised your stay assuming your continuous stay is not broken

Hi Zimba

Thanks for the reply. As you stated at the end of the 30 months period I can apply for the ILR.

Secodnly when applying for ILR i paid £3018 for premium service, am i due for any refund of the fee difference?

Thanka
