TIER 2 VISA holder wanting to bring her child to the UK

Hello,

I am currently working in the NHS and is due to renew my tier 2 visa Feb 2019. I am planning to bring my 13yr old son here afterwards. I just have a few questions and I hope you can help me

1. Can I apply for my sons visa together with mine even if he is in the Philippines? Or is it better to apply for his visa separately?

2. I am his sole parent and although he knows his father - he has not been to see my son for a long time, has not supported my son financially and is not written on his birth certificate. Do i still have to have a written document saying i have sole responsibility? Where can I get this and What other evidence do I have to present?

3. Do i have to apply for a visa as a parent that has the sole responsibility for my son?

4. Can i do the application for him from here in the UK? then he can just present himself together with the relevant documents?

5.Does he have to take IELTS? - He is only 13yrs old.

I hope you can help me with this. Thanks

1. No. You are applying for an extension, he will apply for entry clearance. He should apply after you get your extension.


2. Should be fine if father does not feature on any of his official documents. Note that if you need the fathers consent then you don't have sole responsibility.

3. Yes if that is what you have.

4. You can complete the form online and follow the steps given for him to submit in home country.

5. No.

Don't forget to keep maintenance funds for 90 days. How much you need depend on how long you have been in the UK.

Thanks CR001! Now regarding your answer to my question #3, ( I do have sole responsibility) This parent visa, is this any different from the extension visa that im going to apply? How do i start that application?

Note that it is NOT a 'parent visa' you apply for. You must apply for a Tier 2 Child dependent visa for your son. You apply for the child AFTER your extension has been granted.

I see!! And do i have to fill in the fathers details? As ive written earlier, he is not on his birth documents and he has not seen him for years now but he does know him by name.

If you complete the fathers details which don't appear to feature on any official documentation for the child, then you will have to provide official documentary evidence that you have sole responsibility.

Thank you CR001. Thats most helpful. Just to add, would my mum be allowed to accompany my son coming here as well as visit? It would be very expensive for me to go home and come back again. And i do not want my son to travel by himself too. She is 63 y.o this year.

Hello,

Hope anybody can help. I wrote here sometime ago about my plan to bring my 13yo son to join me here in the UK. What I was planning initially is to go home and come back with him. However I found that very expensive. So now I am planning to let my 63 yo mum (who has been my sons guardian for more than 5yrs now-whilst I am working abroad) to accompany him to come here. She has not been to the UK so this is a good opportunity for her to tour the country.
My worry is that since she will be applying a different type of visa (general visitor visa) compared to my son(tier 2 dependent), is there any chance that she wll be denied? I fear that this is greatly affect my sons application as I will put her name down as the accompanying person. Do I have to prepare anything? I know about the general requirements (financial) that she and I need to meet but Is there anything specific?

Your mother has to meet the requirements of a visitor visa and prove strong ties to home country. if she is refused, no effect on son's visa, they are two separate visa categories and rules.

yes, they are different types of visa application. But from what i read, if I intend for her to accompany my son, i will have to write her name on his application which will be indicated on his visa if approved. What if she is denied? Then will that affect my sons visa since she cant travel with him?

Would it be wise for us to apply for her visa first then wait if she gets approved prior to applying for my son?

His visa is based on YOU and will be issued accordingly.

You simply need to state he will be TRAVELLING with XYZ, assuming she gets a visitor visa.

If she is refused, then you will have to go and fetch him.

Hello there. I would like to ask some advise regarding my sons applications to join me here in the UK. I have finished the application and is now compiling the documents that we need. My situation is that I am a solo parent and in the birth document where it indicates father, it says N/A (not applicable). He knows his father but has not been in contact for a long time and his father has not had any form of support to the child. With this in mind, do i have to have a sole responsibility affidavit included in the documents to prove that I am indeed the sole responsible person and that my mother is the appointed guardian whilst I am away? Where do I obtain this document?
I understand that you need go to somebody who administers oath. Would this be possible through the Philippine embassy?

If the father is not named in the original birth certificate then no additional info or affidavit required and no need to mention father detail in the form.

Thank you for the reply. I feel reassured that I am doing the right thing.

I would like to ask about my mother who is applying for a visit visa. Does she need to have a travel insurance when she applies? I know its not part of the essential requirements but do you reckon it would help? She is 63 years old.
