I've been living with my eea partner for more than 2 years and we have a 2 year old boy. I've just applied for the COA. Do i have a chance ( i'm overstayed) thank you

You have a good chance of getting the COA.

I am assuming your partner is an EEA national exercising her treaty rights in the UK? Working, student etc.....

Hello there.
A bit of clarification please.
I've applied for COA and i received a letter after 2 weeks saying this:

You have submitted an application for COA or civil partnership.
In order to give effect to the recent judgement in the case of baiai others v secretary of state for the home department(2006) EWHC 823 QB (ADMIN) and Court of Appeal Case No C4/2006/1469, we are now making further enquiries in respect of the following categories of applicants. Those who had valid leave to enter or remain at the time of their application but who were not granted more than 6 months leave initially or had less than 3 months of that leave remaining and those who, at the time of their application, has no valid leave to enter or remain.
the purpose of this enquiries is to establish that the proposed marriage or CP is genuine.
To enable considaration of your application you and your fiancee should provide responses to all the following questions Your responses should be provided in separate affidavits clearly signed and date by you and your fiancee.
We've answered to all the questions, send the affidavits.
Do i have a chance? if yes how long is it going to take?
Im overstay living with an EEA partner for 3 years(with prof). She has her resident card and working full time. We have a 2 year old boy.
