Tier 2 General Visa Extension for main application + dependent and ILR

Post by rajamaran » Fri May 31, 2019 10:54 pm

Hello ,

I need a clarification on Tier 2 General to ILR processing and for my wife dependent visa.
Currently I am in Tier 2 general visa and my 5 year completes by end of September 2019. I can apply for ILR in second week of September 2019. But my wife came to UK two years later than me in 2016, so she will be eligible for ILR only in 2021.

So if I extend my Tier 2 general visa and my wife's dependent visa in August 2019. And then If I apply and get my ILR in September 2019, Should my wife need to get a new visa again? Or She can continue in the dependent visa we extend together in August 2019.

If visa extension is given, how long they will give extension for the dependent. I think for me I can stay only for max 6 years in Tier2 general.

Kindly request your advise on this. Thanks. Rajamaran.

So why do you want to apply for an extension if you qualify for ILR in the beginning of September?

Hi We will have a very tight timeline as we have to travel outside UK in early September.
Coming back and applying ILR for me and then applying PBS extension for my wife will be a tight situation. So we thought it would be an option to extend our visas and then process ILR.

How long will you be travelling for and when will you be back in the UK?

To extend your visa, you need another CoS and will only get a 1 year extension taking you as the main PBS visa holder to the maximum of 6 years on Tier 2. IHS is payable plus visa fees.

Once you get ILR, before the extension expiry date, your wife will have to apply for another visa extension for 3 years paying the IHS of £1200 plus visa fees.

Many thanks for clarifying. We are planning to go by 31st August and come back on sep 10th. I think it is ideal to get ILR for me and then apply extension for my wife. Otherwise I would end up in paying more NHS for my wife and unnecessarily for me as well.
Thanks for your support and clarification again.

In that case, you should apply for ILR using the Super Priority service. Once granted and before her visa expires, she can apply for a tier 2 dependent extension.

Hi Thanks again, yes I will go for super priority service. At least if they give extension for three years I can think of applying extension for my wife as well; considering my company will sponsor for me and I pay for my wife. But they would give only extension for only one year and there is no point in extending mine for one year and my wife’s for a year.

Thanks Raj
