Hi all

This forum helped me a lot and thanks to the moderators for the valuable advices

Applied online for Tier1 Ent ILR Set(O) plus one dependent on 05/01/2019
Still awaiting close to 5 months, monthly emails received on every month still under consideration.

I know lots of people waiting from long time like months, years. Etc... there is no standard time scale in this route. Due to personal commitments in back home need to travel as soon as possible

1) if I vary my application from Set (O) to Set (LR) super priority service what documents need to submit or need any covering to explain why am I doing this.

2) still unsure about my eligibility for long residence- when I used to be on student visa left the uk on 30 March 2011 (visa expiry: 31 March 2011) and return back to uk on 1 August 2011 through PSW route applied in home country India on 11 July 2011 visa approved on 27 July 2011. Worried about not applied with I n 28 days window, still my long residence continues or break

3) PBS dependent application need to vary at the same time or vary my application first once I received my ILR then after I vary my PBS dependent to FLR (M)

4) We have paid IHS fee for PBS dependent £600 still we need pay another IHS charge if we vary to FLR (M) or use the same IHS reference number for FLR (m) application

5) please some one provide the link for ukba proved English language test for FLR (m) is it A1 or A2

You need to include a cover letter asking for variation of leave. All documents are now scanned. You upload scans of your documents

As you left before visa expiry and returned within 6 months, your residence is not broken.

Vary to FLR(M) for them too. Include a cover letter asking them to process the FLR(M) after your ILR approval
4) We have paid IHS fee for PBS dependent £600 still we need pay another IHS charge if we vary to FLR (M) or use the same IHS reference number for FLR (m) application
New IHS payment is required

Thank you very much for your reply Zimba (You are a star)

I have doubt in varying my wife application, please kindly help on this.

Example if I vary my application to SET (LR) (Example: 30/05/2019 tomorrow) and book an appointment after 2 weeks for biometric (E.g : 13/06/2019) and vary my wife application to FLR (M) on or before 13/06/2019 it should be fine or HO will reject my wife application immediately once I vary my application to SET (LR).

Due to high fee plus IHS we cant vary both applications at the same time, probably need some gap. I don't know when the HO will refund us the previous applications once we varied.

They will not refuse the PBS dependant straightaway. But when you vary to SET(LR) you should vary their application as soon as you can to minimise the risk of refusal.

Unsure about need all the BRP copies from start to end, I mean for long residence we need to send all the BRP photocopies for the last 10 years.

Unfortunately I can’t find my student extension BRP copy anywhere. Is it makes any impact on the application for long residency

No you do not need to. Passport copies not BRP copies

My current BRP has been expired on 03/02/2019 however I have submitted my SET (O) application on 05/01/2019 (Before visa expiry)

When filling an application form SET (LR) still unsure on some of the options to what to select. Kindly see the below and let me know please

1) What is the end date of your most recent visa, leave to enter or remain or other permission to be in the UK?

Your application is unlikely to be successful if you apply after your current leave has expired. If there are good reasons why you could not do this, you can give more details on the next page.

2) Was there a reason beyond your control why you did not apply before your visa or leave to remain expired? (Required)
For example, you were in hospital or had a death in your immediate family. You will have to prove your exceptional situation if you answer 'Yes'.
Yes
No

3) Are you able to provide a biometric residence permit (BRP) card with this application?

4) Do you have any other reasons for wanting to stay in the UK?

In SET LR application there is the question, When does your current leave expire?

My visa expired on 03 February 2019 but i applied for SET (O) on 05 January 2019

1) What is the end date of your most recent visa, leave to enter or remain or other permission to be in the UK?

Finally I received my ILR through SET (LR)

application varied from Set (o) to Set (LR) on 05/06/2019.

Date biometric attended 07/06/2019 at 12pm then after approval received at 2.35pm on same day

My wife application varied to FLR(M) on 07/06/2019.

Please kindly let me know how to request the refund for previous applications (Tier1 ent ILR and PBS dependent)

Please send any documentation link/guidance to apply neutralisation for my Uk born child

1) Please send documentation link/policy guidance to apply neutralization for child/register as British (Child born in UK).

2) For neutralization need both visa copies (Mine and my wife) or my ILR copy is sufficient. My wife visa application varied to FLR (M) couple of days ago still awaiting.

3) Need to write a letter to HO in relation to varied both applications and ask for refund or they will process automatically.

Refunds are automatic as explained by Zimba above. Give it 3-6 weeks at least.
