Guy's.. do you have any idea (Even from solicitor view) that if the Department not considering change of stumps student under this scheme then how they get their permission back?
Even those student were here legally in between the year 2005-2010!!
Mar_ir,
The last option is humanitarian application and it takes 2-3 years at least. There is no such policy to conclude such application within time frame. Its totally Minister discretion. Its bitter truth my friend.
Any chances to get any positive out come from section-4 before this time frame?
I saw a letter issued to a friend which refused section 4 application. This person had arrived between 2005-2010 and had changed his stamp to 4EUFAM and later the stamp had been revoked (marriage was considered to be fake). He applied on student scheme as well as section 4 (while stamp 4EUFAM was still valid). The section 4 application was refused and the refusal letter said that basically you need to be on a valid visa to be considered for section 4 application and since your permission had been revoked your last permission had expired in 2012 (his last student permission).
They also quoted the decisions of his EUTR application refusal letter and strangely the letter had said his marriage was fake and hence stamp 4 EU FAM is being revoked but *Your section 4 application remains unaffected by the above decision to revoke your permission*. Yet the section 4 application was refused based on his EUTR refusal.
At the last paragraph the letter said we are aware you have applied the student scheme 2005-2010 so we will forward all your files to that section.
