Ancestry Visa Query

Hello,

I am on a Tier 2 ICT Visa in the UK for the past 2 years, my employer has issued the renewed COS for the further 3 years. Along with me are my wife and 2 children on PBS dependant Visas.

Over the last week, we were exploring options to help us remain in the country after the 5 year period, to maintain the children schooling continuity etc. We were given to understand that there was no route available on my Tier 2 ICT main applicant status.

Now, we paid and went through a consultation and were given to understand that my wife actually is eligible to apply for an Ancestry visa, and this would mitigate the need to remain on the ICT visa and allow us to stay past the 5 year period. My questions are -
  • Can my wife travel out of the country to apply for this visa? I assume yes, she cannot apply from within the UK
  • Can my children and I continue to remain in the UK while she applies for her application outside the UK? Again, I assume yes because I am the main ICT applicant and her movements do not affect me, but need advice on this
  • Can I apply to switch to her dependant from within the UK if she is granted the visa?
It is a very confusing and stressful time, any advice is appreciated, I empathise with people in situations like this, it seems like help is available but very hard to get.

How does she qualify for an ancestry visa??

What evidence does she have to prove ancestry?

She is of mixed ancestry, Her grandmother was born in the UK, married to a portugese man during their time in colonized India.

This is all we know now, the evidence needs to be obtained first, and I am sure we can get all of it if necessary, but it needs to be a viable option to be worth the investigation.

You need original documents as follows :

UK born British Grandmothers birth certificate
Grandmothers marriage certificate
Relevant parents birth certificate
Relevant parents marriage certificate
Applicants birth certificate
Applicants marriage certificate

She needs to show evidence of holding the about £1600 for 3-6 months as 'savings'.

She needs to prove she intends to work in the UK as Ancestry visa is an employment visa. UKVI will expect to see evidence of this.

She needs to prove adequate accommodation.

She can only apply from home country.

You could switch within the UK to a dependent visa once she has returned to the UK.
