Claiming Carers Allowance but refused after renewal.. Please help!!

Hi there,

I was wondering if anyone can shed some light on my situation as I’m in deep stress and panic.

My husband is here on a spousal UK visa and is an Egyptian national. When I applied for his visa 2.5 years ago I was getting Carers Allowance which enables you to be exempt from the financial documents. However, my sons DLA has been reviewed at the end of April and it came back as the lower rate which means I cannot claim Carers Allowance anymore. I asked for a re consideration and this came back today as still the lower late for dla, which again means I can’t claim Carers. I’m in deep panic and stress as I have put an application in for my husdands renewal application in already and am waiting for a date for the biometrics. Once I have that date I can upload my documents but I am so stressed out as now the dla has been awarded at a lower rate I will not be entitled to Carers Allowance. My husband has been doing temping work as and when but I’m stressing he may have to go back home. I have 2 kids who he is a step dad to and both get dla lower rate.

PLEASE PLEASE HELP!!! THANK YOU

He can make the 18.6K earnings requirement on his own wages, or on the wages between you. Do you have any savings?

He has no where near £18.6k salary in the last 2.5 years. Also I have been on income support, Carers Allowance and received tax credits for the last 3 years but today I have been told my sons dla is going to lower rate which means from 6 may 2019 I won’t get Carers. I’m panicking so much don’t know what to do as I sent the application off last week so now I dont know what to do. Need to upload and send all documents off next week. I’m on panic mode. I have no savings... what are my options please?

I will now have to apply for JSA instead of income support. So will they take think in to account? Or will they take in to account that I was getting up to 6 may 2019. It’s all been reviewed at the wrong time. Panic mode!!!!

How are you getting Income Support? Have you told the DWP that you have a partner living with you?

I'm not sure why your husband sent his FLR(M) application last week, based on you getting Carers Allowance, when he knew that this had ended?

I was getting income support due to the fact I was getting Carers Allowance. My sons dla came through as lower rate and I appealed against the decision. The answer of the reappeal has only come through this morning and my husbands visa was running out last week. My lawyer told me to submit the application on the grounds I am waiting for the decision. However this morning I have received the decision to say my sons dla will remain at the lower rate. This means my Carers will stop and so will my income support at these two are linked together. Yes income support know that I am married and my husband lives with me however he isn’t entitled to any social funds. The payments are mine and in my name. I will see my lawyer Monday but I’m panicking and wondered if anyone could help give me some advice?

Which would mean that your husband was hardly working at all.

I hope your Tax Credit benefits were in both names? It would be benefit fraud if you claimed as a single person.

If you want advice before tomorrow, you might need to ask on the family boards about what happens when neither of you works much and you can't meet the 18.6 financial requirment between you.

Unfortunately, for your husband, if he had worked he would not be in this position because he could have used his own earnings to meet the 18.6 financial requirement, but doing that would have reduced all your low income based benefits.

Do you realise that now you are movng yourself to Universal Credit by doing something that triggers a move, there will be no transitional protection from any benefit reductions? And that both of you will have to work? And that at least one of you one will have to work full time every week? UC is nothing like the old Tax Credit Benefit that has ended, which had no work requirments for parents.

Thank you for your advice.

I wasn’t working due to caring for my son but I have been studying. My husband has been doing temping work but has been looking for permanent work for ages but had no luck.

I’m not sure how this UC works to be honest. Please can you advise me on how I can post on the family board as I’m new to this site.

Can we apply on the fact Carers Allowance was awarded up until a week before the application was sent?

What grounds can we apply on? My husband has done some temping work in the 2.5 years and I have been a Carer for my son who’s flag has jus been reviewed and he will not be able to get the higher rate anymore which means I won’t be able to get Carers Allowance. Both my sons get lower rate dla and my husband is a step father to them. I will been to go on to jsa now as my income support will stop from July. What other grounds can I apply on? I’m in so much stress and worry

You can use your husband income if he is earning at least £18600 a year on regardless type of contract (even temporary).

His salary doesn’t add up to 18.6k. Do you think they will be able to accept my Carers Allowance for the last 3 years which ended a week before his visa? I’m panicking now as what other grounds can I apply on? My family will be broken and my boys adore their dad. He helps with boys their care and we will be devastated should we hear any bad news
