Tier 2 sponsor notifying Home Office

Post by CHG » Thu May 30, 2019 6:24 am

I am on Tier 2 visa valid till 29/01/2022. My Tier 2 sponsor went into administration on 28/01/2019 and I was made redundant on the same day. Company was declared insolvent and closed in Feb 2019.

Up to now I haven't received my curtailment letter. I am still living at the original address which I gave to UKVI on my Tier 2 visa application. My former company is still on the Tier 2 sponsor list. Only 1 other employee was on Tier 2 along with me and he also hasn't received the curtailment letter. We both have very young dependant children. I suspect HO case worker is exercising discretion in sending the curtailment letter since we both have dependant children.

The former HR manager of my Tier 2 sponsor (who was also made redundant) is adamant that the administrators failed in their duty to inform HO about my redundancy and therefore, my stay is not legal. My partner (on Tier 2 dependant visa) is working full time to pay the bills until we receive the curtailment letter. Former HR manager also insists that this makes my partner's work in UK also not legal. She thinks my subsequent visa applications in UK will all fail due to this issue. I am having interviews with new companies who have Tier 2 sponsorship. One comany is applying for sponsorship next week and want to hire me in Aug/Sep 2019 if they get Tier 2 sponsorship.

I emailed the former administrators of my Tier 2 sponsor. They claim they informed HO of my redundancy on 25/02/2019 and gave HO the date of my redundancy as 28/01/2019. So they missed the 10 day deadline to inform the HO, by 18 days. It is not clear whether they informed HO via the Sponsor Management System or by phone, email or letter. They went through their colleague's work notes and disclosed only the above dates to me. They also instructed me to check with HO whether this has been processed correctly by HO.

Should I inform HO myself about my redundancy? I am vary of doing this in case it will speed up sending the curtailment letter.

Should I write a Freedom of Information request to HO instead to ask whether the administrators informed them about my redundancy?

Is there a phone number that I can call or should I write to the Manchester Curtailment team's address?

Any advice is appreciated.

Your situation is not similar at all. The OP in this topic sponsor went into administration. Very different circumstance to yours where your sponsor withdrew the job offer.
