ILR PBS Dependent - Confusion about applying dates

ILR PBS Dependent - Confusion about applying dates

Hi all,

I am seeking advice for my wife's ILR application. Important dates are as follows:

Tier 2 dependent Visa Issuance: 03 Sept 2014
5 year completion period: 03 Sept 2019
28 days before 5 year completion: 06 Aug 2019

Tier 2 dependent visa expiry: 31 July 2019

That means she is short of 6 days. But I understand that if we apply by post before 31 July 2019, her current visa, expiring on 31 July, is considered to be valid and by the time her ILR application is picked from the queue, she would be well with in the 5 year time frame. Steps that I am looking at are:

1. Application is submitted online, let's say by 25th July.
2. Her appointment for biometrics and document scan is booked for 6th August. Application is now complete.
3. Assume that visa officer picks her application after 6th August. That means she is well with in 28 days before ILR eligibility.

Do you see any issues / problems with above approach? I mean to ask that her application will not be rejected because of not meeting 5 year eligibility.

Looking forward to hearing helpful responses.

Better to apply a day before current visa expiry... the rest is fine and should work out! Good luck
