Ftt dismissed my application for my son’s entry clearance

Ftt dismissed my application for my son’s entry clearance

Pls i need an advice.
I am an indefinite to remain here in the uk may 2018, straight away i applied for my sons entry clearance to come over here in the uk. It was refused by the home office due to sole responsibility issue. I applied for the appeal and i had the hearing and Ftt dismissed the case saying that my son will remain to the country of origin Which will be look after my parents which was old and has medical condition and aunties and the father that he sees sometimes. My lawyer said we are going to apply to upper tribunal. Was that the right thing to do?
Or can i apply for a new application to the home office?

The father is in my country same address of my sons because we lived in the same village. So the Ho thinks that the father has something to do with all the decisions for my son.

What proof of sole responsibility did you submit?

I submitted the certicate from his school that i am the one who has only Responsible for all his tuition fee. And it means i chosen the school where he was studying.
All the remittance money copy. Our conversation from messange of me and my son that we talk almost everyday. Letter from the community leader that he knows me and my son that i am the only responsible to him since me and my husband separated.
All this thing that’s going on makes me really depress i am blaming myself thinking that its my fault that the case all went wrong

It’s same community but different number of house but i mentioned on the hearing that he work far and lives there aswell like 2-3 hours.

That is certainly proof of responsibility, but not proof of sole responsibility, especially if the father lives in the same neighbourhood, while you live in another country.

Do you have court documents granting you sole custody of the child? You need proof of that kind, not proof of generic responsibility for the child, but something that demonstrates that you are solely responsible for the child.

It is very challenging to win a sole responsibility case when the other parent is available and playing a part.

It does not seem to me, that the lawyers explain things and implications to you properly.
