ILR - 5 Year partner route

Post by PM74Juve » Sun Jul 21, 2019 11:10 am

Quick request for ILR application timeline advice:

My partner came to UK on fiancee visa - I know this period is discounted for calculating the 60 month continuous residence so I won't state it.

First period of LTR as spouse 7/12/15 - 5/7/18 (on BRP)
Second period of LTR as spouse 30/7/18 - 21/2/21 (on BRP)

Q1. The period between 5/7/18 to 30/7/18 counts as part of her continuous residence?

Q2. She had 2 periods outside the UK in 2016 (just over 2 weeks for parental funeral and just under 2 weeks to visit friends) - will this be relevant to calculating continuous residence?

Q3. Am I right in saying she could apply for ILR from 28 days before 7/12/20? If not, which is earliest date?

Many thanks in advance.

Many thanks in advance.
