ILR and Separation/Divorce

Post by ImranAhmed » Thu Jul 25, 2019 8:37 pm

Hi,

Me and my wife have been married since 2013. We have been living together in the UK since May 2014. I received by ILR on her basis in May 2019 and applied for Naturalisation.

Out of no where earlier this month she asked me to move out and said this marriage is over and she wants a divorce, with no formal reason given, she blocked me from all forms of communication. I've been trying to reach her now through her family who are shielding her from my contact. I am living on my own after she asked me to move out and have done so.

Meanwhile my questions are:
- If we go our separate way now, how is my ILR impacted which I already have obtained in May this year on her basis.
- How does it impact my Naturalisation application also made in May and still awaiting decision. Can she get that void from Home Office? The decision will most likely go to the old address.
- What are my right and how can I safe guard my interests.

Would appreciate any responses and will be thankful.

:(

1. No effect on ilr unless deception was used to gain ilr

2. No effect on citizenship as the requirement is simply to be married, you can be separated and still qualify as spouse of BC.

3. Don't stress, you are no longer dependent on her for immigration purposes.
