Tier-2 Dependent Child ILR and Citizenship

Post by navishru » Sun Jul 28, 2019 1:22 pm

Hello,
Thanks for the information and time you guys give!
Here is my case:
Father in Tier 2 General visa. Baby born in 2018 in the UK and is planning to go and stay with mom in India for 8 months.
My questions are:
1) can my baby register as a British citizen once I get my ILR since the baby is born here.
2)Baby will be away from the UK for 8 months. Breaking the continuous period of stay. I believe children are exempted from this time of continuous stay to qualify. Is that true and will not have any problems towards her registration right?
3)does she have to take ILR and then become a BC or can she directly register as a BC once I get my ILR?
*baby will join me back after 8 months as a PBS dependent.
Thanks in advance for your replies!

1. Yes.

2. You are confusing immigration rules with nationality law as. A UK born child has an entitlement to register as British once either parent gets ILR.

3. A UK born child does NOT need ilr or a valid visa to register as British.

Unclear when exactly you will apply for ilr.

Thanks CR001 for your timely response!
So the child being away from the country for 8 months will not be a problem for him to register as British citizen when I get my ILR right?
Also, I have another 4 years to apply for my ILR. I did a blunder something of this sort in Germany which led to lose the continuous period, hence preparing from the beginning not to make any mistake!
Thanks again for your time!
