immediate advise required!!!!!!!!!!!!!!!!!!!!!!!!!

Post by askahlon » Wed Jul 09, 2008 2:00 pm

I applied for PR in Canada in July 2002 at the CHC, New Delhi . In Feb 2008 I was asked to update my file which i did. However earlier(in DEC 2007) my elder son went to US for his masters. In May 2008 I received medical papers and PCC was asked by the CHC. I called my son back from USA got the PCC and Medical exam done. My son could stay here and wait for the passport request because his semester was finished and holidays were going on. Now I have recieved the Passport Request but they have demanded the following things:-
1) PCC of my son done from US
2) FBI fingerprints of my elder son
and have given me a time period of two months for this.
I have immediately sent my son bact to US for all this stuff.
Now the problem is
1)FBI clearance takes 16-18 weeks while I have at most 8.
2)Even if he sends all these documents within the time period, we can't take a risk by calling him back here because by that time his semester would have started in US and his passport can't be sent via mail or any courier service.
3) Even if he comes and submits his passport along with whole of my family, then we are not sure how much time will they take to issue the visas. What if they take more than 6 months and say no because of some reason or the other and by that time my son's US visa will also get cancelled and his career???????????????????????

Please reply with any useful advise immediately.

Thank You

1)FBI clearance takes 16-18 weeks while I have at most 8.

Inform and ask in writing(e-mail or by post) to the Canadian embassy, asking for an extension. If the reason is genuine and if you can supply any evidence for this, you will likely to get an extension as requested. It is not just you facing this 16-18 weeks delay, this could be anybody and the embassy deals with thousands of application every day and night, they should aware of the real time scale to get a FBI clearance.

2)Even if he sends all these documents within the time period, we can't take a risk by calling him back here because by that time his semester would have started in US and his passport can't be sent via mail or any courier service.

Yes, this is a risk but you can probably bring back the passport if someone reliable travels from US to India(may be illegal, you may want to check this out, or your son may be left with no documents in USA while his passport is in India - another risk). Or ask the embassy in India that whether your son can get a visa stamped in canadian embassy in USA. Best thing, ask the embassy in India and have their answers in writing as a proof.

3) Even if he comes and submits his passport along with whole of my family, then we are not sure how much time will they take to issue the visas. What if they take more than 6 months and say no because of some reason or the other and by that time my son's US visa will also get cancelled and his career???????????????????????

Not sure about India but Canadian Embassy will send you passport request only when everything is okay. I think, they might give the visa in couple of days if applied in person or 60 days if by post. This is in UK, check this times with embassy in India, it could be longer wait period in India. Again ask embassy and get them agreed everything in writing and send this copy of their agreed extensions etc., when you submit passports, so that the person reviewing your case won't reject it as he has the letter from one of their agents agreed for this extension.

Good Luck.

(As a side note : I would prefer to stay in India rather than Canada if I am not single and young. I would only move to Canada if I have most of my family lives there. India has more to offer than Canada these days, apart from little higher money but if u are moving as a family, you have more hassle, the extra money that you may earn may not be worth it - Just my opinion)
