Birth Certificate - Whether mandatory for PBS dependent visa extension?

Post by nikhiljoshi07 » Tue Jul 30, 2019 8:36 pm

Background: I hold an ICT tier 2 visa and staying in UK since 11 months. My wife came to UK last month on her ICT tier 2 visa. My kids arrived in UK along with my wife as PBS dependants on my wife's ICT visa. My wife was issued ICT Tier 2 visa for 2 years. Kids however were issued visa lasting until my visa expiry date (4th Aug 19) instead of a period of 2 years matching with my wife's visa tenure. Reason being - the UK visa rules for PBS dependant kids state that the visa for kids will be granted in line with a period which expires on the same day as the leave granted to the parent whose leave expires first.
Hence, when i was applying for my visa extension and went for a bio metric appointment last week i also applied for my kids PBS dependant visa along with me.

Questions i have are
1. Was i supposed to provide my kids Birth Certificate along with the visa extension application? When they had applied for the visa originally as my wife's dependants their birth certificate was submitted along with their visa application form. In the Document Checklist issued by Home office for the visa extension application i was not asked to provide the Birth Certificate of kids. Also, my company who is sponsoring my ICT tier 2 visa and applied my and kids visa extension on my behalf did not ask kids document to be submitted at the time of bio metrics.

2. There is a likely hood after our visa's gets extended (assuming i and kids do get their visa extended) that in near future i may have to travel to my base location(country) for an indefinite period but my wife would continue to stay in UK until her ICT visa tenure gets exhausted. Will my kids who are PBS dependants be allowed to stay in UK as their mother who is on an ICT tier 2 visa is in UK and continues her employment in UK? Or am i supposed to take them with me to my base location (country) as their visa extension was done along with my visa extension thereby they become PBS dependant on me although when they landed in UK they were PBS dependant on my wife? Point to note that the BRP card for PBS dependant kids does not mention the name of the PBS parent(s) thereby not specifying the parent on whom they are dependant.

Appreciate if someone can provide their inputs or share their experience.

1. Not required.

2. Are the children applying as dependents of your visa or dependents of your wife?? This is crucial as if applying as your dependents, their visas are wholly dependent on you being in the UK. The BRPs don't mention the parents name, only the visa vignettes do.

Thank you for your prompt response. While applying for visa extension the kids are applying as dependants of my visa. All though when they applied for the original visa they had applied as my wifes dependants. Its like... they landed in UK as my wife's dependants and extending their visa under my extension as my visa gets over before my wife.

Hope this answers your question.
