ILR for Wife with Dependant Tier Visa - break in period of stay in UK.

Post by mastermind19 » Sat Aug 03, 2019 5:36 pm

Hello Team,
Pls see below details of Visa Issue / Expiry / UK Entry dates of my Wife on Tier 2 Dependant Visa.

First Time 'Tier 2 Dependant Visa' Granted & Visa Stamp Issued - application whilst in India.
2014-July-21 : Visa 'Valid From' Date.
2014-Aug-15 : Entered UK for the first time.
2016-Nov-19 : Left UK, and went back to India.
2017-Jan-15 : Visa Expiry Date.

Her current Dependant Visa expired before she could enter back to UK ... as such I had to make a Fresh Tier 2 application.

New 'Tier 2 Dependant Visa' applied whilst in India.
2017-Apr-18 : New BRP Issue Date.
2017-May-13 : Date of Entry into UK.
2020-Jan-22 : New BRP Expiry Date.

In above case, how do I calculate 5 year for my wife's ILR application.
Does her period of stay in UK from 2014-Aug count towards 5 years ?
or Does it start all over again from 2017-April/May ?

(Main Applicant, myself - I currently hold ILR valid until 2024)

Pls advise. Any ques, pls let me know. Thanks.

PBS dependants have no absence limit when visa was issued before Jan 2018 however I believe her stay is broken as she failed to apply for a new visa 14 days after the visa expiry
