ILR DEPENDENT for Partner and Child

Post by Buntybobby » Tue Aug 06, 2019 8:42 pm

Hi I am going to apply ILR in August. I would like to apply ILR DEPENDENT for my wife. Can I add my child as a dependent on the same application? If yes do I have to pay the IHS for my child along with my wife?
Current status of my wife and Child is Tier 2 dependent.

If you don't meet the 90 days maintenance funds for tier 2 dependent extension, then yes you can fill in one form and add the child. Yes you have to pay IHS for the child. There is no exemption.

Note your spouse and child must complete FLR(M) and not be added to your form. Note also that if your ILR is refused, their FLR(M) will also be refused.

If you will get your ILR after 5 years on tier 2 then they can continue to extend as tier 2 dependant without resetting their qualifying time for ILR. None-British applicants either adult/child need to pay IHS.
The opinion expressed as above is neither a professional advice nor contesting/competing to other member's opinion/advice.

The OP doesn't meet the 90 days maintenance funds for a PBS Dependent extension.

It isn't a 'tier' visa. It is form for m you need to apply for a spouse settlement visa. Google is amazing.

Settlement for Child

Post by Buntybobby » Wed Aug 07, 2019 12:40 pm

Hi
I read guidance given on the website related to the child visa and my understanding was that a child is eligible to settle in the UK if at least one of your parents has indefinite leave to remain or proof of permanent residence.
I am going to apply for ILR at the end of August and ILR DEPENDENT for my wife. My son is born outside UK. Can some one confirm me whether I can go for Settlement for my son or not?
My son is 16 months old..

Not relevant to your child. The child will follow the same path as your spouse.

Which guide exactly did you read it in?

https://www.gov.uk/uk-family-visa/child

This is where I read
It applies when either parent does not have a limited leave to remain visa and it does also say MAY and not definitely yes. As your spouse is applying for a spouse visa, the child follows the same path and ilr as the spouse. The immigration rules are fairly clear on this.

ILR DEPENDENT

Post by Buntybobby » Fri Sep 13, 2019 11:43 pm

Hi
My wife is currently on pbs dependent on tier 2 migrant.. I recently got settlement Visa. Can I switch her to family Visa?
The reason for this question was I read in the FLR m guidance that the following person cannot use this form
"As the partner of a person granted indefinite leave to remain in a work route, if you are currently
in the UK as their dependant. See our website for further details: https://www.gov.uk/visas"
Can someone clarify the issue?

Hi I used the same link as my guidance to fill in the information. But yesterday I have come across what it is known as FLR m guidance where it says that I cannot use FLR m form in my situation or atleast from what I understood from that. In the link you have sent yes it clearly says that we might be able to switch to family Visa. So could you please clarify me on this

You can switch to FLR m. The rules allow this. It will reset the 5 year ilr clock to zero though and 2 X 2.5 year visas.
