Indefinate Leave to Enter

Post by jkproperties » Wed Aug 07, 2019 10:27 am

Hi Everyone,
I have applied for my UKM and expect this to be concluded in the next month or 2 hopefully.
My wife was born to a British Father so will apply for a British Passport as soon as we receive her parents marriage certificate.

We have applied for Unabridged and Vault copies for our children but we are still waiting for my sons Vault Copy.

1)At what stage can we submit ILR/E for our children aged 12 and 14?
2)Is a Vault copy required for the ILE application or will the Unabridged suffice?
3)How long should we expect to wait for approval of ILE?

Thank you,
Have a great day,
Jaco

You will need to meet the adequate maintenance and accommodation requirement for the children to get a visa.
1)At what stage can we submit ILR/E for our children aged 12 and 14?
When you have the British passport for your spouse and you are British after your ceremony has been attended and you have your certificate.
2)Is a Vault copy required for the ILE application or will the Unabridged suffice?
Unabridged should be fine.
3)How long should we expect to wait for approval of ILE?
It can take anywhere between a few weeks to a few months.

Note you will be applying for a child settlement visa, they don't always get granted ILE and often get a 2.5 year visa instead. If you are not yet British, they will unlikely qualify for the visa if you don't apply at the same time.

Hi CR001,
Thank you for your reply,

We do not currently live in the UK so I have no accommodation to prove, what would you suggest we do here?
I do have family in the UK but do not intend living with them.

Ok, My understanding was that My children would get ILE automatically because we will both be British Citizens, how would this affect them becoming Citizens? would they have to complete 5 years then apply for ILR and then only Citizenship?

I really hope this isn't the case, as both will then be over 18.

I don't know if I understand your last statement?
As per your response on the first question I will be British as I will only apply after my Certificate is in hand.

Thank you again for your reply.

If they could provide a letter and council tax bill for temporary accommodation it should be fine.

If they are granted ILE, which is the same as ILR by the way, they can apply for citizenship after 2 years if they are under 18 at that time.

My statement was IF you applied for the children BEFORE you are British.

Thank you for clarifying,

So what would determine if they get ILE/R versus the 2.5yrs Visa?

I know it's the same but have been flamed a bit for using the ILR in comments as we are not yet in the UK, so it is ILE.

UKVI caseworker. The children should get ILE, but there have been reports from a small number of members where they have not.

ILE (enter) is applied for only outside the UK.

ILR (remain) is applied for only within the UK.

Oh my soul, I am now a little stressed out.
hopefully they will get the ILE.

But if they do not, what are the implications? Is there a difference in costs? NHS fees etc.

Oh I have just received an email from home affairs, I need to do a late birth registration for my son.
I received an abridged and unabridged birth certificate 2 months ago, and now suddenly he is not registered??

Visa fee per person is £1523 and IHS is £1200. ILE no IHS payable usually.

I would ignore their email.
