Long term 10 residency ILR

Post by Alifat123 » Mon Aug 12, 2019 11:01 pm

Hi Immigration experts:

I came to UK in January 2010 and planning to apply for my ILR on long term residency 10 year route in January 2020

1) What documents will i need to submit when applying for ILR? I came to uk as student extension my visa in 2011 and moved onto tier2 post study work, then I moved onto entrepreneur visa in 2013 and switched my visa to tier 4 dependant as my wife is doing PhD which is due to expired end of 2020. Will I still need to show any documents related to limited company when I was on enternur visa? Or I don't need any of that will that only be travel history and legal stay in uk for 10 years proof required?

2) my child was born in uk and she is 4 months old. Do I need to apply for her naturalisation first using MN1 form I think it's called once I get my ILR? Or do I need to apply for my child same time as my ILR application?

3) my wife came to U.K. As my dependant in march 2015. She switches to student tier 4 visa in around march 2016. Once I get my ILR do I need to apply for her spouse visa separately ? What exact form I need to fill or what is the exact category name?

4) some friend told me as you and my wife have been living together since march 2015 in U.K. He said as your 5 years of living together will complete in march 2020 she will get her ILR on that fact. Is that true? If not then I assume going on spouse visa for 5 years will lead to her ILR?

5) last question please. The salary requirement will that only be £18,600 I need to maintain and show 6 'months salary to apply for wife spouse visa? As I have been informed for my child I don't need to show salary as she was born here and ll get her naturalisation automatically once I get my ILR as there is no salary requirement for naturalisation? Thank you once again for being patient and going through my questions.

No need to provide evidence for such periods unless asked

Children do NOT naturalise, they have to be registered as British. You simply apply under MN1 after your ILR is granted. No need to apply for a visa for your child

She has the option to switch to FLR(M) but that has an income requirement. However residence under FLR(M) is much better than Tier 4 as she will permitted to work as well as to study.
4) some friend told me as you and my wife have been living together since march 2015 in U.K. He said as your 5 years of living together will complete in march 2020 she will get her ILR on that fact. Is that true? If not then I assume going on spouse visa for 5 years will lead to her ILR?
ILR is based on continuous residence under certain visa categories NOT based on the length of your marriage. Your wife is under Tier 4 which does NOT lead to ILR. If she switches to FLR(M), she needs 5 years under FLR(M) to be eligible for ILR. The other option is if she completes her 10 years on her own.
5) last question please. The salary requirement will that only be £18,600 I need to maintain and show 6 'months salary to apply for wife spouse visa? Children do NOT naturalise, they have to be registered as British. There is no income requirement under MN1.
The income requirement is only for FLR(M) and you need 6 months salary slips from employment if you did not change your job in the last 6 months. Otherwise 12 months.
