Advise needed -Tier 2 ICT Dependent Visa to Tier 2 General Visa

I am reaching out to you to seek advice on our visa situation, wherein I am main applicant holding the Tier 2 ICT visa which is valid till May 2020.

I have submitted my resignation and would be returning back to my home country on 13 September. My employer has asked me to initiate the clearance formalities which includes visa cancellation.
I wanted to understand how does the visa cancellation impact my wife's dependent visa as she is currently working here and needs to serve her notice period (until 24 September).

In addition to this, my wife's employer is willing to sponsor her a Tier 2 General visa and the formalities for the same would take time (beyond 24 September)

I have the following questions and would request you to guide me on these

• If my visa gets cancelled by 13 September and I return back to my home country, Is my wife allowed to stay in UK to serve her notice period (24 September)

• f my employer decides to delay the visa cancellation will this impact my wife's new visa application for converting from Tier 2 ICT dependent to Tier 2 General visa

• Also I would be applying for a Tier 2 General dependent visa, can this happen only after my current employer cancels my Tier 2 ICT visa

NO she has to leave the country with you

Your wife is dependent of you not your company. She can change to Tier 2 general from home country

no you can apply it anytime in UK or home country upto you.

Note also that it is your employers sponsor duties to inform HO within 10 days of your last day of work that you are no longer being sponsored. It is not your responsibility to do this.
