My name its Hector. I am writing because I have a question about an application that I would like to make. I am Mexican married to a French national for about 2 years. I already hold the 5 year EEA Family permit. However my wife has lived for 5 years in the UK including the period we have been married and so have and so have I with 3 years of student visas prior to our marriage. Hence we have both now lived in the UK for 5 years but only 2 as a married couple.

My question is wether I as a non-EEA citizen can apply for permanent residence in the Uk or wether I have to wait for reaching 5 years of marriage(which for me would be a total of 8 years in the Uk) to apply??

You are eligible for permanent residence having resided continuously in the UK with your EEA spouse for 5 years. The time you spent as a student does not count towards your permanent residency under EU Regulations. Therefore you may be eligible for PR in 2011.

So that means the two of you married in 2006? Can you say what month in 2006 you married? The reason for the question is that the EU regulations changed part-way through 2006.
