Tier 2 - Extension - General Questions

Hi Everyone,

I am soon going to apply for Tier 2 (general) extension. My current visa expires on 29th of September 2019. I have a few questions and I hope the specialists would help me kindly.

Q1) I believe my sponsor company needs to generate an "Unrestricted CoS". Am I correct?

Q2) The last date of the work is 15th September, Can the new start date be 16th of September?

Q3) With the new extension for three more years, my total stay in the UK will reach nearly six years but not exactly six years, is that ok?

Q4) I will be applying for the same job with same SOC, I believe I am exempted from RMLT, am I correct?

Q5) Do I need to prove my English language? I am totally lost here due to various opinions that I have read so far from different sources. I am sorry.

Q6) Initially I was on a tier-4 visa from 2013 until 2016, I then switched to the current Tier 2 visa in 2016. I have a valid masters degree. Should I submit it along with the application to prove my English language requirement?


Now, I will also be applying for Tier 2 Dependent visa extension for my wife at the same time as mine as her visa expires the same day. I have a few related questions and I hope you guys will kindly help me ease my worries. She received her dependent visa in the month of October last year. She cam to UK to live with me for a month and then returned to home country. Now she has come back last week to stay with me.

Q7) Does she need to prove that she is living with me? If so, what documents she would need to provide along with her application. Unfortunately, no house bills are under her name.

Q8) Should we need to provide evidence of chat or call while she was away for couple of months after her first visit to the UK? and any subsisting marriage evidence should be provided whilst she is with me now?

Q9) My sponsors has ticked the box for maintenance as "Yes" in the new CoS for me. Do I still need to provide a letter from the company stating that it will bear the cost for one month for my dependent (£635)?

Q10) Finally what mandatory documents she needs to send and what supporting documents she should include to support her application?

Should'nt be a problem, you pay extra fees and IHS if you apply for more than 3 years,

Not required for extension applications.

For extension not required, but the address you enter in the form should be same.

Not required for extension.

If you are both are applying at the same time, there is no requirement to show maintenance.

Not exactly sure about the current, shouldn't be more than passport, brp and photographs, rest everything is required to be filled in the application form, but please double check. You also get a checklist at the end when you complete online form.

Please let me know whether we should provide evidence of co-habitation? if so for how much period, only since she got her leave to enter (6 months ago) or since our marriage (1.2 year ago)?

What sort of evidence is accepted?

Should be fine but try submit a bit more if you have in either your names. You need documents in both your names, either jointly or individually addressed and more than just one document.

I just have one more question. My wife is currently pregnant, would it help with the tier 2 dependant visa extension application if I include documents proving the pregnancy assistance we are taking from the NHS?

Hi CR001,

Thank you for your help. Please forgive me for asking another question. I seem to be overthinking the process as I have faced the refusal twice (with my first attempt for tier2 application and my wife's first attempt for PBS dependant last year).

My question is, my employer has ticked the box where it asks for certifying the maintenance for migrant and dependant in the CoS. Should I still take a letter from my employer stating that it will bear the cost of £££ amount each if required for a full month starting from new employment date for both of us?

I sincerely apologise for the trouble I am giving you with simple questions but as you may understand I am getting overly conscious about everything that I read on this forum.

Hi,

I have just applied for my tier 2 visa extension. For extension there is no requirement to show maintenance funds. This is clearly stated on my submitted application form.

My company still ticked the box for maintenance however they don't provide letters of amounts etc. They didn't provide first time round either where I was required to either have the company providing maintenance or me showing my own funds.

For your relationship proof submit whatever you have. On the list of docs required marriage certificate is mandatory. Then there is an optional doc required which is to submit a utility bill, council tax bill or bank statements etc. I guess any tenancy agreement can work as well. Better to be safe and submit some proof your partner is living with you than not to submit.

Hope this helps.

PS: I am not a specialist on this matter either just personal experience.

My concern is for my wife who is dependant and I am applying for her dependant visa extension at the same time and in the same application. Do I need the letter for her? I certainly have not maintained the required amount in bank account for 90 days.
