Opposite sex civil partnership

Post by D4N1L01990 » Wed Aug 28, 2019 12:07 am

Hi all,

I posted here some time ago, but wanted to check again with you now that the UK government has extended the right to enter a civil partnership to opposite sex couples too from 2020.

I am an EU citizen and I got the pre-settled status. My girlfriend is non-EEA citizen, she studied in the UK with a student visa, then she came back to her home country where she's currently working, and she got a visitor visa to come and visit me for short periods. Now we are considering entering a civil partnership next year. This is our understanding:
- first she'll have to apply for a EEA family permit as a proposed civil partner. On the government web page for EEA family visas there is nothing for proposed civil partnerships or fiancées, but in other pages they say that this is the visa to apply for if the resident in the UK is a EU citizen without indefinite leave to remain
- she'll have to come to give notice, which should happen at least 70 days before the planned date to give the Home Office the required time to review. She'll leave after this
- she'll come back to enter the civil partnership and stay with me
- after the ceremony she'll apply for the family visa/EU settlement scheme

Are we missing something in our "plan"? We can prove that our relationship is genuine, that we are in contact every day, that we have spent at least one week per month together after she has left the UK, that we want to be together and plan our future together. Another thing is that both our home countries would not allow us to enter a civil partnership.

Any advice, suggestions, comments to make our application stronger and more likely to be approved will be very appreciated. Also for what to include as supporting documentation in the application.

Many thanks
