10 year ILR

Hi there, due to apply for my ILR in a few days,
But I found I might have a break between my visas.

I applied for my T4 extension on the 29th of Nov 2011( expires on the 30th of Nov), rejected as invalid on the 11th of Dec as I didn’t sign the application as the visa team “forgot” to ask me to do so. Reapply on the 12th, visa granted on the 4 of Feb.

Does that count as a break for more then 28 days?
As far as I know from the 30th of Nov to the 12th of Dec, I wasn’t covered under 3C, but do I after I re apply?

Best is to apply your SAR file from UKVI to check your immigration history in their records to exactly find it out.

Done it and it is been 4 months, and UKVI keep saying they are working on it.

You applied within 28 days of becoming an overstayer and then later you were granted leave. Your period of overstaying will be discarded for long residence

Thanks for the reply,

I have sent them over 5 emails already, all replied with they are working on it.

The reason for asking is I have also been told the break is counted from the date my last leave expried till the date they issue the new Visa.

Now I think I got a much better chance of getting ILR.

A outline of my immigration history if that helps

1. First entered the UK at 13th of Sep 2009 with T4 visa, Valid till 30/11/2010

2. Visa extension made on 29/11/2010, new leave valid till 30/11/2011.

3. (this is what i thought the break was), Visa extension applied on the 29/11/2011, got retuned as invalid, re submitted at 12th of Dec, and granted new visa at 04/02/2012 valid until the 30/09/2014.

4. new extension made on on the 29/09/2014, granted on the 24/10/2014, valid till 15/01/16k, but this visa got shorten to 15/08/2015 as the college got closed down by the home office.

5. Got married at the 15/07/2015, and applied for T4 PBS dependent on the 06/08/2015, granted on the 14/09/2015, valid until 27/01/2017.

6. New exdension applied on T4 PBS Dependent on 25/01/2017, granted on the 08/02/2017, valid until 04/12/2021.

Appointment at 9 this morning
All went well and left at around 10.


Got email from HO saying the application is granted 30 mins ago.
