Applied 6months early for ILR poorly an oversight

I I need advice from anyone who has been or knows how to deal with a situation like mine please.My timeline is
Applied for ILR on behalf on my husband on the 17th August 2019 used super priority service
29th enrolled his biometric at 11am
4:21pm same day an email received stating the home office has fullfilled their obligations so the super priority service fee won't be refunded and a letter has been sent and instructions must be followed.
Letter received yesterday ILR refused because application was made to early poorly an oversight from me as i was checking the visa date in the passort rather than the biometric card,he has been asked to pay an additional 1000 for IHS and being pushed down the 10year route, his visa doesn't expire till much what can we do please any help or advice deeply appreciated.can we use a solicitor to withdraw happy to loose the money to get it right.Thanks and anticipating your response.

Useful to state his immigration history and all visa dates etc.

Is it a spouse settlement visa and ilr on form set m or a PBS dependent visa on form set o?

What date did he enter the UK? Was it on a spouse visa or a 6 month fiance visa??

His residence starts counting from date of entry to the UK and not visa grant date or brp date.

You do NOT have to pay IHS etc if he still has a valid visa. You can simply ignore Jo request.

Sorry about that this is my 1st time using your website he was on a spousal visa,1st granted 11th December 2014,he entered the uk 28th jan 2015,his further leave to remain was applied on the 30th August 2017 and his visa runs out march 12th 2020 please.

Ignore his letter and apply again when he meets the requirements after 1 January 2020.
