hsmp rejected->Workpermit

Hi All,

As expected my application was refused. . Would anybody know if I could make an appeal either paid or unpaid in country since my student visa has expired last year and prior to the expiration, they advised me that I am okay to remain in the UK under my current status and conditions
whilst the HSMP application is being considered and without filing any FLR of any kind. The decision letter was dated 8 March 2005 but I just receive it today 22 March 2005. Would anybody in this forum know how long I could stay to lodge an appeal in country.

Another question I have was, I just receive an email today that I got a job offer from a company who is willing to sponsor me a work permit. Would I be able to switch to workpermit under this conditions since my leave to Remain has expired. Do I have to go back to my home country
to start on a clean slate again. Any advise would be highly appreciated

Sorry to hear about your rejection. Could you pliz share with us more details of your application as i am a bit confused having gone thru some of your posts.
Can you tell us when you applied, you seem to be in the UK is that correct, what visa are/were you on ? what you claimed points for? and also more importantly the reasons given for your refusal

I applied for the HSMP incountry application and got rejected on the work experience letter. my previous letter was something like this

The responsibilities he has been carrying out were to gather market information, analyze interpret and determine implications for business decisions and finally to develop business and financial solutions in line with the business needs. Some of the tools and technologies used were Visual Basic, Visual C++, SQL Server, UML etc. He possesses strong analytical and problem solving skills along with brilliant programming skills.

This role is normally offered to graduates having a minimum educational standard of a UK first degree level qualification or equivalent. The candidate does not necessarily have to hold a degree but the post normally requires one. In overall service he proved himself as a skillful, devoted and honest worker. His strong communication skills are also a quality. I wish him a very bright future.

Note: All of his work experience (more than 4 years) within the company should be considered as a full time professional work without any training period.

With reference to paragraph 7.2.1 of the HSMP guidance notes, the evidence provided should demonstrate that the job roles undertaken would normally require a minimum educational standard of a UK first degree level qualification of equivalent. We were not satisfied that sufficient evidence was provided to demonstrate any graduate level experience as described in the published guidance notes of the HSMP arrangements. Consequently we were unable to award points for this category.

My case was refused earlier on the same reason, at that time it was written in my reference letter that i was doing a graduate level job. After getting refused i copied the exact text from their guidance notes but still they are not convinced.
All of my work experience is from my home country Pakistan, the letter is on the company s letter head and signed by the director.

Shall I go for the paid service like workpermit.com

I applied last year 19 july and I am on student visa. My visa expired the following month but before that I ask the HO if I need to fill out any FLR form to keep in status since students are allowed to switch to HSMP. They replied I am ok to stay with my current status and conditions whilst my HSMP is considered. Before I received my refusal letter last 22 March, I received a job offer 21 March from a company who is willing to sponsor a work permit. I am planning to lodge a paid appeal to keep in status while waiting for my work permit to come out. Will there be any problem when I apply for FLR since there's a big gap on the expiration on my visa. Any ideas guys?

It is a very said to know about your refusal. Can you share with us some more details. Was the HO satisfied with your diploma? Did they award you with any points for education?

Hi there!

Have a similar sad story - refused HSMP on the 15th of March. Submitted on the 23rd of September 2004.
Sudent visa expired in October 2004. My solocitor told me that I must leave the country in 28 days otherwise will be removed by Immigration services. But that is a bit hard as I am doing an expensive Master's degree in the UK university and taking exams now. Do not know what to do.
Can I submit another application in-country???????
Please help if you can guys!!!!

Hi guys!

I know for sure now (contacted HO) that once your student visa expired you cannot make any fresh applicationas of any kind except for the HSMP free review request. All other applications including a fresh HSMP can only be made on out of country basis. You are normally given 28 days before Immigration can remove you.

I called Home Office too and they said in theory you cannot apply for the student visa from in country but because the fact that your passport was held by the home office -- we may consider your case.

Hi Helena,

Even if it means that I have already a job offer. I have just received my letter 22 March but the letter was dated 8 March so two weeks have passed without me knowing it which is unfair. Does that also mean that my employer cannot apply my work permit within the 28 days appeal period assuming it would start from the day I received the refusal letter.
