Accommodation requirements for Spousal Visa

Post by JJR » Tue Sep 03, 2019 1:45 pm

Hi everyone,

I have ILR and am getting married to my boyfriend who is currently based in New Zealand. As his sponsor, I'm preparing all of the documentation and am slightly worried about my accommodation situation not being deemed adequate.

I have been living in the same flat for the past five years which I sublet from my flatmate who is the head tenant. I signed my contract with my flatmate and the landlord is fine with this situation as he does not have to manage the property, but would a letter from my flatmate agreeing to my boyfriend moving in be acceptable or would I need to have one from the actual landlord?

Thank you

Sorry but does anyone have any advice on this query? I appreciate that it's an odd situation but if it won't be accepted then I need to figure out an alternative quickly.

Ok thank you. If I sign up with a new landlord but it is still a shared house, will a letter from the landlord be sufficient or will I also need a property inspection report?

If you share a property with other non-related people, you need a property inspection report.

Also if the new landlord is not your relative/friend then you will also need tenancy/lodger agreement apart of noc letter.

I have just heard back from my landlord who refuses to sign any of my documents, including a sublet agreement between him, myself and the subletting landlord, ie my head tenant. He has asked the head tenant to sign and that he would back him up, but I'm not sure this will be adequate?

It may not work then because other than the landlord/estate agent nobody can give you tenancy agreement/lodger agreement which is needed for visa purposes.

Thank you for your help. I'm now exploring the option of signing up to rent a one-bedroom flat. I spoke with an Estate Agent and explained my situation and they then offered to supply a letter for £350, is that normal? I'm also worried about having a new address and supply proof, will changing it with my bank suffice?

Remind them about Tenant Fees Act 2019 & Penalties
