Certificate of enrollment to Right of abode - queries

Post by achukar » Thu Sep 05, 2019 11:59 am

Please could you help in the below query and thanks for your support.

The child is born in UK to ILR Father and FLR mother, then the child is british citizen by birth.
then the parent's register the birth in Indian embassy, to get the Indian citizenship then apply 'Certificate of enrollment to Right of abode' on the Indian passport for the child, instead of applying British passport,so that child can live in uk.

After the age of 18,then if the child wants to continue with Indian citizenship, as the indian law does not allow dual citizenship then whats needs to done, as the child does not have British passport only has 'Certificate of enrollment to Right of abode' on Indian passport.

Regards,

In addition to the above, which one of the below is true??

1, The child has only COE-ROA and after the age of 18 then child can continue to retain COE_ROA as having COE-ROA does not impact Indian citizenship ?

2, In order to renounce british citizenship, The child has to apply british passport first then renounce british citizenship to retain indian citizenship if the child was having only COE-ROA up until the age of 18 ?

3, There is a way to renounce british citizenship having only COE-ROA so that Indian citizenship can be retained after 18 years ?

I'd you renounce British citizenship, you lose the CoE/RoA entitlement.

Thanks CR001.
Do you mean to say child can continue to have Coe-Roa without impacting Indian citizenship after 18 years.

If you renounce British citizenship child likely loses the right to hold a Coe/RoA.

It is only a British citizen who does not hold a British passport that can hold CoE/RoA. So if you renounce their British citizenship, they won't qualify for CoE/RoA and will have no status in the UK.
