Be prepared for an interview.
Thanks tier11417 for reply. I'm preparing my self for an interview.
I only have 1 employee working full-time from 5 years and some others worked part-time. Now rules are changed. In case of negative outcome from this application I wouldn't b able to reapply as I don't have 2 employees working full time not even combining part time employees.
Do I have any other options?
I came to UK in December 2009 and completing my 10 years on 9 December 2019.
Thanks
I hope that you are not called for an interview. However, the recent trend suggests that an interview is likely after a complex letter. Having said that, I hope that they take longer and you can vary your application on 10 years basis in Dec 2019.
Having one employee could be a problem cz yes you will not be able to meet the new requirements incase need be to re-apply.
Do you have any dependents?
I would like to see others comment on this:
Is it possible to change the job title. For example employee A working 12 months for JOB 1 and the same employee A working 12 months for JOB 2 for the next 12 months??
@marcnath @zimba @aman
Thanks tier11417.
My wife and kids joined me in December 2014.
Can I vary 2nd application to ILR(LR)?
Thanks

It’s odd but possible. E.g admin to sales.

Perhaps. Depends on the nature of ur business!

Ur dependants clocks will reset and will have to change their route.
You can vary ur application to LR 9/12 minus 28 days

Can I apply for LR after the decision on my current application if decision comes before.
When the section 3C will expire?
Will I still be protected by section 3C after the decision and during the admin review?
How much time admin review will give after the decision if it's covered by 3C?
Maybe I'm overthinking but as I'm worried and trying to work out all possible outcomes.
Thanks for all of you helping me.

You can't vary your application once it is decided.
You are covered under Section 3C until a decision is made on the AR of the first application.
If AR decision is negative, then you can make a second application within 14 days, which you can then vary to ILR(LR) if a decision is not made when you are eligible to apply.

Marcnath has advised you!
I can only add that relax.. something will work out.
You may or may not be called for an interview but be prepared thoroughly.
For ur dependants sake I hope you get it via Tier1.

Can I vary my 2nd application to ILR(LR)? If that's the case it will be very helpful. Is any guidance able for this.
After reading other posts my understanding was different.
I thought section 3c will expire when applicant submit 2nd application and can not vary that 2nd application.

Read immigration rule 39E.
That allows you to make a new application within 14 days of a refusal or appeal. The new application can be varied. I’ve seen a number of successful applicants on this forum.
If it happens in ur case then you’ll have to most probably work on delaying till you reach ur LR qualifying period but making sure all submissions are in in time..

I did some research and also find this topic on the top as well. There are some problems or changes in 39e. Because of a recent judgement they are not quite hopeful.

There is really no point of this convo now..
Take it as it comes.
Your understanding is incorrect.. the rule is not dynamic or going through changes or whatever you said.
The argument is whether the stay is regularised by making in time applications...
And in the mean time if one reaches 10 years would the waiting period during the application process be counted as legal stay.
A number of applicant have been successful and a a number haven’t.
Unfortunately that’s the risk you’ll have to take.
Or you can leave the country and come back on a visit visa... and then apply for LR

Hello,
I applied ILR on 01-03-2019 and received a complex issues letter on 26-07-2019 didn't receive anything after that. I also applied for extension of my dependants with my application.
1-Can I vary my dependants extension application into ILR application?
2- Will they refund application fees and IHS fees if I vary application?
Dependants 1st visa issued on 26-10-2014 and 1st entered in the country on 05-12-2014.
Thanks

I think you should be able to vary it but for avoidance of doubts you can call HO to find out.

Thanks marcnath and bizman.
I have more trust on this forum members ( marchath,CR001, zimba,Aman tier11417 and others) thn on HO call center as I have seen them giving different opinion on same matters.
I'm trying to find some first hand information or a document which I can trust.
I will only vary this application if I'm getting full refund ( IHS and application fees). Otherwise will wait for my application's outcome as I received complex issues letter and don't want to waste double fees.
Thanks

Calling HO is one of the most useless things one can do as it’s outsourced and you’d get better help via google...
Nothing is ever certain.. but going on previous posts.. IHS fee is refunded too.

Hello everyone,
I'm waiting for my ILR application submitted on 01-03-2019 and complex issues letter received on 26-07-2019. Dependents (wife and 2 kids) also applied with me for extension.
I'm completing 10 years on 11th November 2019 (after taking 28 days).
My current annual income is £19700.
I'm requesting Macranth, Zimba, CR001, tier11417, Aman and all other members to advise me in the following situations:
1- if I receive a negative result before completing my 10 years.
2- if I vary my current application into ILR LR after completing 10 years.
3 - If refused after completing my 10 years.
Please give your valuable opinion which will help me to prepare my self before hand.
Thanks

Youve asked this question before and it has been answered. There is nothing new to add to reassure you.
The below link is a good example.
indefinite-leave-to-remain/apply-for-se ... l#p1826824
1.You can apply within 14 days for AR, buy time and then apply for LR within 14 days of AR refusal.
2. Varying is an option..
3. You can apply within 14 days for LR

As I mentioned my annual income is £19700. If I apply ILR LR what will happen with my dependants?
They can't apply set m but can they extend stay or they need to go back to the home country?
Thanks

I think it’s gonna be FLR(m) without leaving the country. Were ur children born here, how old are they, how many dependants, do you have savings?
