Is there any grounds on which application of child under section 1(3) can be refused?

Not usually no. Provided the at least one parent is settled or has PR/ILR and if over 10 that they meet the good character requirements, then it shouldn't be any issues.

Remember that section 1(3) is for UK born children who have an entitlement to register as British.

Thank you so much for your prompt response.
Secondly I have a friend who's separated from her eea partner but not divorced, and has a child with another man, on what grounds can she register her child?
Does the child qualify to be registered under section 1 (3)?

What is the immigration status of the mother?

What is the immigration status of the "other man"?

Note that under nationality law, the father of the child is considered to be the mothers husband usually.
