My British Citizenship Application

Dear all,

I have 12 months to apply for my BC application but just want to make sure I know the requirements and prepare accordingly. As far as I know I would need the following:

1) All passports/stamps to prove residency for 5 years and must be in UK at the start of the 5 years period. Cant be outside UK more than 450 days in 5 years and 90 days in the last 12 months.
2) ILR- BRP to prove freedom from immigration restrictions.
3) LIUK and English Requirements (already met at ILR stage).
4) Online AN application form.
5) 2 Referees.
6) Good Character.

Question1: As far I know there is no income/employment requirement for BC application.

However, I am the director of my limited company and also on the company’s payroll.

So does that mean I am self employed or an employee or both? Being an employee my taxes are paid by the employer (my company’s) PAYE scheme, but if I am considered self employed the AN guidance says I need to provide latest self assessment??

Please clarify on the above point.

Question 2) Also do I need anything else or the above list is sufficient?

There is no requirement to be employed or send evidence of such for British citizenship. No self employment activity is asked to be reported.
You only need to enter employment periods and details. PAYE details are only needed if you are currently on the payroll (currently employed)
These will be used to cross check that you only worked in the UK when you had the legal right.

Thank you for your quick response Zimba. I think I got confused page 31 self employment line. I think that is for people applying BC on marriage basis only then?

Question 3: If I apply on 3rd May 2020 (My ILR issue date is 2nd May 2019) and I have not lived outside UK for 90 days. Can I travel after I apply? How will the 90 days rule work?

For example if I travel on the 7th May 2020 after I apply for my BC application. Is that allowed?

You are allowed to travel after your application has been submitted - be aware that UKVI can ask for additional information regarding your application.
90 days absence: Normal permitted absences in final 12 months of your qualifying period.

If I understood correct, I can travel outside UK after submitting my application as long as I qualify for the “less than 90” day rule in the previous 12 months on the day of application.

Dear all,

As of my knowledge the online form asks for 10 years of employment history (if any).

So in my case it would be 2010-2020.

I was employed for around 6 months with a company on my PSW visa.

I applied for my initial Tier 1 Entrepreneur visa in Dec 2013 and was granted on 24th Jan 2014.

I cant really recall what date is on my P45 as I do not have any P45 or any payslips in my record now from 2013-2014 but on top of my head I left work end of January 2014 maybe 30th Jan 2014 (as I was serving the notice period) so I probably worked a few days over (4-5 days).

I went on vacations on 10th Feb 2014 so I was not even in the country. I was not employed later on until I created my own company in June 2014 and since then I have been a director and on the payroll of my own company.

Q1: Can the 4-5 days overlap of being employed elsewhere after grant of initial Tier 1 Ent be a concern?

Q2: Is there a way I can have access to my P45 to know the exact date of leave from Jan 2014?

Dear all,

I am director of my company and at the same time employed and on the payroll of my company since 2014. My NI/Tax is paid by the employer (my company) PAYE scheme.

The form asks for 10 years employment and gives options to choose from:

1) Director
2) Employee
3) Self-employed
etc

Question: Am I right to assume I will tick “employee” and just state my employer’s (my own company’s) PAYE reference number

OR

would I tick “director”?

Which will be the correct option?

I just read closely and the question says “select all that apply”

If I am correct I would choose both the options “director” and “employee”.

Since my NI/Tax is paid by PAYE scheme no additional documents are needed. The docs checklist also did not ask for any documents related to this.

Please confirm if my understanding is correct.

Dear all,

I got my ILR on 2nd May 2019 and plan to apply for my BC application on 27 May 2020.

I know that one of the requirements is that I have to be in UK at the start or the 5 year period. In the above case that would be 28 May 2015 which I was in UK.

I know one of the requirements is that I cant be outside UK for more that 90 days in the last 12 months.
So that would be 28 May 2019 - 27 May 2020.

Question1: Am I correct to assume that I am okay if I was not in the UK on 28th May 2019 i.e. the start of the last 12 month period??

Question 2: I was away from 20th May 2019 - 10th June 2019 this year.

If I apply on 27th May 2020 next year, will I count my absence from 28th May 2019 even though I left UK on 20th May 2019 in this specific trip?

I am actually travelling a lot this year so getting very close to my 90 day limit. I want to make sure I do not exceed that.

The 90 days absence in the 12 months is the 12 months immediately preceding the date of application, regardless of what date you went abroad.

I called my previous employer and they confirmed my leave date on P45 from 2014 is 31st Jan 2014.

However, the date on my initial Tier 1 BRP is 24th Jan 2014 and I must have received it around 27-28th Jan 2014 given the weekend.

Should I just mention the accurate date i.e. 31st Jan even though its after my Tier 1 initial approval?
