hi,

I have some questions that you guys may answer here.

I obtained ILR in 2010 but after 9 months i moved abroad for work. I kept coming back to UK each year to keep my ILR status active. I even got married abroad and had 2 kids there.

I then decided to move back to UK full time with my wife and 2 kids in Oct 2016 (exactly after six years). I moved back to UK alone first to get a job and then got six months of wage slips to apply for my wife and both kids visa from abroad. They joined me in September 2017. I even had a new baby girl born in Manchester in June this year and just yesterday i received her British passport because i have a valid ILR and this baby is born in the UK. My other two kids who were born outside UK are on normal 5 years visa.

So this is the story so far. Let me ask you 5 questions now.

1 - When could i apply for the British passport for myself? It has been 3 years now since i am back in the UK and working full time. I read it is 5 years but please confirm.

2 - My wife and kids got 33 months visa and that will require renewing it in March 2020 for another 2.7 years before they could apply for ILR that is after 5 years of their stay in the UK. Is that correct? I read on a blog that my 2 kids born outside UK could apply for the British passport after 3 years being in the UK? Is that true?

3 - Another question related to point 2 is that what is the fees for visa extension that i have to pay in March for my wife and 2 kids? Please also tell me the IHS charges? I guess we don't have to pay for all 5 years again. I just want to know the total fees for their visa extension to arrange by March 2020.

4 - Next question is that when my wife and 2 kids born outside UK completes their 5 years. I will apply for their ILR and after a year for their British Passports. What is the current fees for IRL application per applicant?

5 - Final question is does my wife have to do life in the uk test before apply for the ILR? I guess it is not required for the 2 kids. Any other requirements we should keep in mind for ILR application?

In order to meet the permitted absence limit you will need to wait until you are able to comply with the following:
- No more than 90 days outside the UK in the 12 months prior to submitting your application; and
- No more than 450 days in total outside the UK across the five years prior to submitting your application.

Your two children born outside of the UK will follow the same immigration path as the less privileged parent...in this case your wife.

I guess we don't have to pay for all 5 years again. I just want to know the total fees for their visa extension to arrange by March 2020. For each applicant, £1,033 visa fee + £1,000 each for the NHS surcharge = £6099.


4 - Next question is that when my wife and 2 kids born outside UK completes their 5 years. I will apply for their ILR and after a year for their British Passports. What is the current fees for IRL application per applicant. Currently the application fee for ILR is £2,389 for each applicant. Your wife will require A2 English from a Home Office approved test/test provider

5 - Final question is does my wife have to do life in the uk test before apply for the ILR? I guess it is not required for the 2 kids. Any other requirements we should keep in mind for ILR application? Your wife will require B1 level English + the Life in the UK test.
