I am looking for the solution for my wife who is Tier 2 dependent visa with me and she is applying for ILR and we have below situation:
I am currently under Tier 2 working visa and some important dates for me:
- Tier 2 visa issued: 23/01/2015 (which I applied within U.K. before it is Tier 4 student visa)
- Current Tier 2 visa expiry: 23/01/2020
- Earliest ILR application: 27/12/2019 (23/01/2020 deduct 28 days)
So I am planning to apply/submit application on 27/12/2019.
Then my wife she was with my Tier 4 dependent visa and stayed in U.K. before and there are some key dates for her:
- Tier 2 dependent visa issued: 01/03/2015 (which she applied within U.K. and the date for her visa is bit delay because of after my Tier 2 visa granted then she submitted her and her one been granted on 01/03/2015)
- Current Tier 2 dependent visa expiry: 23/01/2020
- Earliest ILR application: 02/02/2020 (01/03/2020 deduct 28 days)
So she is still more days short than above case I think because in order to have five years she has to say until 01/03/2020 and if she can only apply 28 days before 01/03/2020 which will be 02/02/2020 and her visa has been expired on that time. In this case does it mean she has to extend her visa for actually short period to eligible this five years? or any other solution?
Sorry to ask this question again and I hope can prepare for this thing before last minutes.
