Family visa + ILR in process

Hello

I have applied for ILR and its accepted, I have the email saying that it is granted and that the BRP will be sent within 10 working days. It has now past 10 days and we have raised the question to the HO to find its whearabouts. Few other forums on this site says sometime it may take up to 2 months to get the BRP - this makes me worried.

We want to apply for short term family visa for my in-laws to take care of my baby due soon .

I was wondering since I dont have the ILR BRP with me and not knowing when it will be delivered, would it be acceptable to use my existing tier 2 general BRP/visa to apply for my in-laws' visa? I am sponsoring them.

Appreciate any help or direction with this please.

This would be considered child care (unpaid/volunteer work) if they are coming to look after a child. Not permitted on a visitor visa.
I was wondering since I dont have the ILR BRP with me and not knowing when it will be delivered, would it be acceptable to use my existing tier 2 general BRP/visa to apply for my in-laws' visa? I am sponsoring them.
Your tier 2 visa is cancelled now and no longer valid if you have been granted ilr and you will likely have to rerun the brp to ho.

Although you may still have a valid tier 2 BRP, you no longer hold a status of temporary resident anymore, thus the application for you in-laws won’t succeed if you use a previous BRP.

To avoid additional difficulties from Home Office for being misinterpreted as child care, just apply for your in-laws for a tourist visa under the basis they will meet for the first time your newborn child (only If they genuinely will spend time with him and not perceive any wage for that).

Thanks for the reply. I should have made it clear that they are visiting us for one week and for any help needed for my wife and not necessarily just for the baby. Absolutely no wages involved.
They would then spend 5 days site seeing across country and they return to their home country.

So would tourist visa be apt this case as you suggested? I assume they dont need to be bothered with my documents like brp which i have not received ?

You shouldnt declare your previous immigration status which has been cancelled rather simply can use your present status which is ILR regardless whether you have received your BRP card or not. But if you will mention the reason that your in laws is coming to look after your newborn baby then it will even affect the case because eco will more likely believe that she wont return within her stated time.

Then apply for a visitor visa for them, and omit “they are going’s to take care of the child” because it’s misinterpreted as a child care. Don’t mention it, just say they will visit your newborn and their daughter.

On the other hand, make sure your in-laws are providing enough evidence to demonstrate strong ties to their home country, and they will return at the end of the visit in the UK. I’ve seen a rise in the number of refused visas for visitor parents/in-laws since they are unable to demonstrate ties to their home country.

thanks for the replies and direction.
My in-laws circumstances have changed so they wont be travelling after all.

This, however, has given me good information about things to consider and I will definitely seek advice from HO or solicitor if needed.
