Tier 2 dependant Visa extension - Maintenance source

Post by Goldy0210 » Thu Sep 26, 2019 9:30 pm

Hi,

I am applying for my Tier 2 dependant visa extension. My husband is now on ILR so his company can’t sponsor my maintenance. I don’t have enough funds in my bank account, can I show my husbands bank statements for my maintenance proof??

Thanks in advance.

On what basis did your husband get ILR, 5 years Tier 2 or 10 years long residence??

You can use either your or his bank statement but it must be held for a minim of 90 days without dropping below £630 at any time.

Hi CR001,

Thank you so much for your quick response. Much appreciated.

My husband got his ILR on 5 year, Tier-2 basis.

Also, IHS is asking me to pay £2200 as my husbands BRP has a validity until DEC 2024. Does this mean that I will get the extension until then??

I came to the UK in August 2018. My current is expiring this December.

You need to put the ILR BRP expiry date 3 years from the date you are applying, i.e. X day September 2022 to get the correct amount of £1200 for a 3 year extension.
I came to the UK in August 2018. My current is expiring this December.
You will get a 3 year extension and will likely need another 3 year extension before you can apply for ILR.

What was the initial start date of your dependent visa?

Your clock for ILR starts from visa issue date but you will still be short of a few months and will need another extension which again is for 3 years.

Does applying through an FLR M will help in any case instead of applying for multiple tier 2 extension?

Many thanks.

No. If you switch to FLR M, your whole clock resets to zero and a new 5 year route to ilr, 2 X 2.5 year visas, before you can apply for ilr. Visa fee is also more, currently £1033 plus IHS of £1000 and you need to meet more strict requirements. There is no absence limit though, which you do have in your current visa.

Hi CR001,

Some immigrantion lawyer told a friend that it should be my bank statement that I will have to show. Is there any way to confirm that my husbands bank statement will be accepted for my visa extension?? I have already applied online for the extension and I can’t go wrong in this. I don’t have the required funds in my account to show for 90 days. Can you please guide us?

Thanks in advance.

Either spouse's bank statements can be used. Nowhere does it state it must be the applicants only.

https://www.gov.uk/government/publicati ... rs-1-2-4-5

Page 15 on this guidance (pt 79-83). If you can please read this and let me know if the way we have applied is correct.

Sorry for the trouble but we can’t risk the application being rejected.
