Tier 2 ICT to Dependent visa

Post by alka » Tue Oct 01, 2019 3:57 pm

Hello,

I am currently at UK on Tier 2 ICT visa since June 2017. My spouse was in ICT dependant visa.

My spouse recently got Tier 2 General Visa and just came to UK after stamping from my home country.

Can I change from ICT tier 2 main applicant to Dependent visa (of my spouse ) within UK without 1 year cooling off?

Please let me know.

Thanks

Yes.

Note there is NO cooling off period if switching to a dependent visa from Tier 2 main visa holder!!

Ok. Thanks. One more question.

Once I switch to Dependent visa from Tier 2 ICT main applicant within UK without cooling off,

Can I switch again to Tier 2 General visa from Dependant visa without cooling off?

If the above switch is possible, can I switch within UK or need to go back to home country ?

Please let me know.

Thanks

No cooling off applies to tier 2 ICT to tier 2 general. You need to hold a dependent visa for 12 months before you can apply for tier 2 general.

You have to apply from home country for tier 2 once 12 months since tier 2 ICT is complete.

Ok. Thanks

What do you mean to hold dependent visa for 12 months before applying Tier 2 general visa?

Do you mean that following:

1) if I want to work in UK with dependent visa then I can work as long as my spouse Tier 2 general visa valid

2) if I wanted to switch from dependent visa to Tier 2 general visa, then i need to go back to my home country and stay there for 1 year and then apply to switch from dependent visa to tier 2 general from home country.

Please confirm the above please.

Thanks

1. Yes

2. No. You can stay in the UK for 12 months. You can only apply for tier 2 general from home country once you have held tier 2 dependent visa for 12 months, ie NOT been a tier 2 main ICT visa holder for 12 months which is the cooling off period.
