Post by expat_uk » Wed Oct 02, 2019 10:23 am

Hello i hope you can help me. My partner got ILR august 2019 under tier2 now we need to extend as a dependant (me plus child). Our visa will expire 15th december 2019.
1. When can we apply?
2. Can i apply first then once approved apply for my daughter (issues with funding).
Thanks in advance

1. Whenever you meet the requirements, i.e. 90 days maintenance funds of £1260 etc. but you must apply online before your visa expires.

2. Ideally you should apply together to avoid delay as HO will almost certainly write and ask about the child.

Maintenance funds

Post by expat_uk » Wed Oct 02, 2019 10:36 am

I am confused about maintenance funds i need to extend as Dependant partner already ILR my question is

1. do we need funds for 3 person (me,partner and child).

2. Or just funds for me and child which is 630x2 as my partner already got her ILR

Thanks in advance

Kindly refrain from tagging onto other members topics.

Maintenance funds only for the two applicants applying @ £1260 and NOT for the ilr holder, as already advised.

Thank you for response and sorry it’s my first time to post here. Just want to confirm about the funds so my partner whose already ILR don’t need £945 funds on top of the funds for 2 dependants. We only have £1,500 that’s why I’m a bit worried. Thanks in advance.

No as an ILR holder is no longer a sponsored migrant.

Tier 2 dependent visa extension

Post by expat_uk » Tue Oct 08, 2019 1:21 pm

hi I need some advice. Partner already ILR expiry is 2024. I am due for extension and my current visa expiring in dec 2019, I arrived here in 1st January of 2016. My questions re the following:
1. I only needed 1 year to stay in England to apply for ILR, is there one year option for extension or do I need 3 years and less?
2. I want to know if im allowed to pay 1 year IHS only or do I need to pay 3 years again? but what if they will not give me a 3 year visa? can I get a refund?

Thanks in advance

Please do not tag your questions onto other users topics. Stick to your own topic please, this one now merged with your recent post.

1. No there is no '1 year option'. The immigration rules Part 8 clearly state that a PBS Dependent will get a 3 year extension if the main PBS migrant has ILR. There is no discretion by HO on this.

2. No. You have to pay 3 years as your extension will be for 3 years. You don't get IHS refund if you apply for ILR.

https://www.gov.uk/healthcare-immigrati ... on/refunds
You will not get a refund if:

your visa application is successful but you do not come to the UK
you leave the UK before your visa ends, for example to make a new application
you’re told to leave the UK before your visa expires
you’re applying for indefinite leave to remain or changing to another visa where you do not need to pay the IHS

Hi,

Just wanted to clarify a point mentioned earlier in this thread.
We completed the online application for visa extension before the expiry of current visa. However the appointment date for submission of documents is a week after the expiry of the visa (we could not get one sooner). Will this be a problem?

Thanks.
