Tier 2 Unmarried Partner - Separation advice

Post by london172019 » Fri Oct 04, 2019 8:25 pm

Hello,

I am looking for some advice on my situation. I have recently come to the UK on a tier 2 unmarried partner visa and have been working for the past few months. Sadly, my partner wishes to separate.

This leaves me in a sticky situation where I will need to leave the UK. As I have notice periods, etc. I am wondering - once he reports our separation to the home office am I given some sort of grace period before I need to leave? I have read somewhere it is 60 days but I am hoping to have some confirmation on this. To confirm, my employer will not sponsor me for my own visa.

HO can take a few months to send out a curtailment letter, which will reduce your visa validity to 60 days.

When visas are curtailed, the expiry date will be reduced to 60 days from the date of HO's letter, not the date you resign or leave your job.

Thank you

So to confirm: Potentially the letter could take - 1-2 months + 60 days. ?

The letter could take anywhere between 2 and 8 months. You also should not travel out of the UK if your partner has informed HO as you could be denied re-entry and your visa cancelled on the spot.
