PBS dependent maintenance funds question

Post by Bond001 » Sat Oct 05, 2019 5:30 pm

I am currently in a state of confusion. My wife Tier 2 (Shortage Occupation) application was granted on 12th June, 2019 and she travelled to the UK on 28th June. She got the Visa without showing proof of funds as her employer (A rated) had certified Maintenance for her (and dependants) if applicable. .

I applied and did my biometrics for Tier 2 Dependant Visa on 3rd October, 2019 and i am super worried. I am worried because i submitted my wife's COS only as evidence of maintenance.

What are my chances that my application will be successful? Has anyone had their application granted in this same situation?

My understanding is that main applicant already in the UK , so you need to show maintenance. As you are dependent on your wife not on sponser. if you would have applied together, situation would be other way.

lets wait for exports opinion

why dont you send bank statements with minimum maintenance requirement to HO asap, before they consider your application with covering letter.
This can be yours /wife or combined.

If the sponsor has certified maintenance for dependents, why are you stressing?

If you are worried, then submit bank statements with a cover letter as suggested but HO reserves the right NOT to considered this after submission of application.

Read this guidance:
https://assets.publishing.service.gov.u ... 3-2019.pdf

Point 83

This doesn't apply as the main tier 2 migrant only arrived in the UK recently after getting ENTRY clearance and maintenance funds requirement is mandatory.

Note that extension within the UK do NOT require maintenance funds evidence.

My assumptions are:

- The main applicant is already in the UK
- The main applicant didn't have to show proof of maintenance (Employer license covers maintenance)
- The OP is applying separately from the main applicant

The main applicant had to show maintenance fund proof in the form of the CoS that would have been ticked that sponsor is covering maintenance funds. Proving maintenance funds is mandatory for ALL Tier 2 entry clearance visas.

It is not the 'Employer license' that covers maintenance. Not all employers tick the box on the CoS to certify maintenance. It varies greatly.

The OP has to meet the maintenance funds requirement for an entry clearance dependent visa, either with 90 days bank statements or evidence the tier 2 employer has certified maintenance for the main tier 2 visa holder and the dependent, in this case the CoS with the box ticked.

Thank you for taking the time to explain. It's clear now. It's always compulsory but either demonstrated by the funds being held at bank or certified in the CoS by the employer.
