I have been recently granted Indefinite Leave to Remain in UK on the basis of 5 year route Tier 2 visa previously. My tier-2 visa is valid till February 2020. I am trying to extend my wife’s visa who is currently on tier-2 dependent visa which is expiring on 12 January 2020. It is mentioned in the new guidelines issued in September 2020 from UKBA’s website that PBS dependent can apply in the same category to complete 5-year probationary period before applying for ILR
I am applying for my wife’s visa in PBS Dependent – Partner category and while I was filling the application it indicated to choose the category of tier2 (General) leave to remain even if main applicant has been granted ILR (which has happened in our case). However, it never asks for my ILR but asks for COS of my tier 2 category. Eventually when we reach to the step where we need to pay IHS surcharge it again asks for visa category of main applicant (me) and my visa type and does not show any option for ILR. I indicated my tier 2 visa and expiry date(12/02/2020) and it only calculates IHS surcharge of £200 which does not seem correct as that seems like only fee for 6 months rather than a year.
My wife will be eligible to apply for her ILR by next year December therefore we would at least assume the system to calculate IHS surcharge for an year if not 3 years.
Can you please help me with the enquiry.
